A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to a requirement that a state agency reveal the identity of |
|
certain anonymous complainants to the person against whom the state |
|
agency has initiated a contested case. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subtitle A, Title 10, Government Code, is |
|
amended by adding Chapter 2010 to read as follows: |
|
CHAPTER 2010. DISCLOSURE OF CERTAIN |
|
INFORMATION BY STATE AGENCIES |
|
Sec. 2010.001. DEFINITION. In this chapter, "state agency" |
|
means an officer, board, commission, department, or other agency in |
|
the executive branch of state government with statewide |
|
jurisdiction that makes rules or determines contested cases. |
|
Sec. 2010.002. IDENTITY OF COMPLAINANT. At the time a state |
|
agency initiates a contested case against a person under Chapter |
|
2001 in a proceeding that was initiated on the basis of an anonymous |
|
complaint, the state agency shall disclose to the person the |
|
identity of the complainant. |
|
SECTION 2. The change in law made by this Act applies only |
|
to a complaint filed with a state agency on or after the effective |
|
date of this Act. A complaint filed with a state agency before the |
|
effective date of this Act is subject to the law in effect on the |
|
date the complaint is filed, and that law is continued in effect for |
|
that purpose. |

SECTION 3. This Act takes effect September 1, 2011. |
