A BILL TO BE ENTITLED
 
AN ACT
  relating to certain employment and occupational licensing
  restrictions based on a person's prior conviction.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 22.092, Education Code, is amended by
  adding Subsection (c-1) to read as follows:
         (c-1)  Notwithstanding any other law, a person is not
  ineligible for employment in a public school as a food service
  worker solely because the person has been convicted of a
  nonviolent, nonsexual offense.
         SECTION 2.  Subchapter B, Chapter 53, Occupations Code, is
  amended by adding Section 53.027 to read as follows:
         Sec. 53.027.  ELIGIBILITY FOR CERTAIN LICENSES. (a)  This
  section applies only to a license issued under:
               (1)  Title 3;
               (2)  Title 7;
               (3)  Title 8; or
               (4)  Title 12.
         (b)  Notwithstanding any other law, an applicant may not be
  denied a license to which this section applies based solely on the
  applicant having been convicted of a nonviolent, nonsexual offense.
         SECTION 3.  Section 522.081, Transportation Code, is amended
  by adding Subsection (i) to read as follows:
         (i)  Notwithstanding any other law, a person may not be
  disqualified from driving a commercial motor vehicle based solely
  on the person having been convicted of a nonviolent, nonsexual
  offense.
         SECTION 4.  This Act takes effect September 1, 2021.
