relating to contracts for family support services. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter A, Chapter 265, Family Code, is | ||
amended by adding Section 265.0042 to read as follows: | ||
Sec. 265.0042. FAMILY SUPPORT SERVICE CONTRACT. (a) In | ||
order to increase permanency options and other beneficial outcomes | ||
for children and youth in the conservatorship of the department, | ||
the commission shall contract for family support services with a | ||
statewide organization that: | ||
(1) is exempt from federal income taxation under 26 | ||
U.S.C. Section 501(c)(3); and | ||
(2) is composed of individuals or groups of | ||
individuals who have expertise in family finding and adoption | ||
support services on a statewide basis in other privatized settings | ||
with verified metrics and results. | ||
(b) The commission shall include in the contract under | ||
Subsection (a): | ||
(1) measurable goals and objectives relating to the | ||
number of: | ||
(A) child placements; | ||
(B) children receiving services; and | ||
(C) children who are adopted; and | ||
(2) required practices designed to ensure compliance | ||
with standards referenced in the contract. | ||
(c) The commission shall ensure that not more than 10 | ||
percent of the annual legislative appropriation to implement this | ||
subchapter is spent for administrative purposes by the statewide | ||
organization with which the commission contracts under this | ||
section. | ||
SECTION 2. This Act takes effect September 1, 2021. |
