A BILL TO BE ENTITLED
 
AN ACT
  relating to medical gas and vacuum piping systems testing in
  certain health facilities and voluntary tester registry.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 222, Health and Safety
  Code, is amended by adding Section 222.0055 to read as follows:
         Sec. 222.0055.  TESTING OF MEDICAL GAS AND VACUUM PIPING
  SYSTEM. (a)  In this section, "health facility" has the meaning
  assigned by Section 221.003.
         (b)  The executive commissioner and the Texas State Board of
  Plumbing Examiners shall jointly adopt rules consistent with
  plumbing industry standards related to verification of the
  integrity and content of a medical gas and vacuum piping system
  installed in a health facility.
         SECTION 2.  Section 1301.058, Occupations Code, is amended
  to read as follows:
         Sec. 1301.058.  TESTING OF MEDICAL GAS AND VACUUM PIPING;
  RULES; REGISTRY. (a)  A person is not required to be licensed under
  this chapter to verify medical gas and vacuum piping integrity and
  content.
         (b)  The board and the executive commissioner of the Health
  and Human Services Commission shall jointly adopt rules consistent
  with plumbing industry standards related to verification of the
  integrity and content of a medical gas and vacuum piping system
  installed in a health facility, as required under Section 222.0055,
  Health and Safety Code.
         (c)  The board by rule shall create and maintain a voluntary
  registry of persons who are qualified to verify medical gas and
  vacuum piping integrity and content.
         SECTION 3.  (a)  Not later than January 1, 2018, the executive
  commissioner of the Health and Human Services Commission and the
  Texas State Board of Plumbing Examiners shall jointly adopt rules
  required under Section 222.0055, Health and Safety Code, as added
  by this Act.  Rules adopted by the commission that are in effect on
  the effective date of this Act continue in effect until superseded
  by joint rules adopted as required by this Act.
         (b)  Not later than January 1, 2018, the Texas State Board of
  Plumbing Examiners shall create the voluntary registry required
  under Section 1301.058, Occupations Code, as amended by this Act.
         SECTION 4.  This Act takes effect September 1, 2017.
