A BILL TO BE ENTITLED
 
AN ACT
  relating to public-private partnerships to design, develop,
  finance, construct, and receive financial assistance for certain
  water-related projects.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter H, Chapter 15, Water Code, is amended
  by adding Section 15.4745 to read as follows:
         Sec. 15.4745.  PUBLIC-PRIVATE PARTNERSHIPS.  A person that
  receives money from the fund may enter into an agreement with a
  private entity to design, develop, finance, or construct a project
  described by Subchapter I, Q, or R of this chapter, Subchapter E or
  F, Chapter 16, or Subchapter J, Chapter 17. Money from the fund may
  be used to make payments under an agreement entered into under this
  section.
         SECTION 2.  Subchapter I, Chapter 15, Water Code, is amended
  by adding Section 15.5345 to read as follows:
         Sec. 15.5345.  PUBLIC-PRIVATE PARTNERSHIPS.  An eligible
  political subdivision that receives money from the fund may enter
  into a contract as described by Subchapter A, Chapter 271, Local
  Government Code, with a private entity to design, develop, finance,
  or construct a flood project.  Money from the fund may be used to
  make payments under a contract entered into under this section.
         SECTION 3.  Subchapter Q, Chapter 15, Water Code, is amended
  by adding Section 15.9805 to read as follows:
         Sec. 15.9805.  PUBLIC-PRIVATE PARTNERSHIPS.  An eligible
  political subdivision that receives money from the fund may enter
  into a contract as described by Subchapter A, Chapter 271, Local
  Government Code, with a private entity to design, develop, finance,
  or construct a project.  Money from the fund may be used to make
  payments under a contract entered into under this section.
         SECTION 4.  This Act takes effect September 1, 2021.
