A BILL TO BE ENTITLED
 
AN ACT
  relating to electric reliability standards adopted by the Public
  Utility Commission of Texas.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 38.005, Utilities Code, is amended by
  adding Subsection (g) to read as follows:
         (g)  The independent organization described by Section
  39.151 shall determine the amount of reserve capacity necessary to
  maintain a 1 in 10 reliability standard in the ERCOT power region.
         SECTION 2.  Not later than January 1, 2022, the Public
  Utility Commission of Texas shall determine whether the reliability
  standards adopted under Section 38.005(g), Utilities Code, as added
  by this Act, ensure that the Electric Reliability Council of Texas
  power region's electrical network maintains the necessary amount of
  reserve capacity.  The Public Utility Commission of Texas shall
  report its findings under this section to the legislature.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2021.
