A BILL TO BE ENTITLED
 
AN ACT
  relating to the preference given by state agencies for certain
  goods and services produced or offered by small businesses.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter H, Chapter 2155, Government Code, is
  amended by adding Section 2155.454 to read as follows:
         Sec. 2155.454.  PREFERENCE FOR SMALL BUSINESS. (a) In this
  section, "small business" has the meaning assigned by Section
  2155.505.
         (b)  Except as provided by Subsection (c), the comptroller
  and each state agency that enters into a contract for the purchase
  of goods or services with a value of less than $500,000 shall give
  preference to goods or services produced or offered by a small
  business.
         (c)  This section does not apply to the purchase of
  telecommunications equipment, telecommunications services,
  advanced communications services, or information services, as
  those terms are defined by 47 U.S.C. Section 153.
         (d)  The comptroller may adopt rules to implement this
  section.
         SECTION 2.  The change in law made by this Act applies only
  to a contract for goods or services that is entered into on or after
  the effective date of this Act. A contract entered into before the
  effective date of this Act is governed by the law in effect on the
  date the contract was entered into, and the former law is continued
  in effect for that purpose.
         SECTION 3.  This Act takes effect December 1, 2017.
