AN ACT
  relating to certain county and public health district fees.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 437.012(b), Health and Safety Code, is
  amended to read as follows:
         (b)  The [Except as provided by Subsection (f), the] fee
  charged by a county or public health district for issuing or
  renewing a permit may not exceed the amount necessary to recover the
  county's or district's cost under Subsection (d) [$150].
         SECTION 2.  Section 437.0123(b), Health and Safety Code, is
  amended to read as follows:
         (b)  A county or public health district that requires payment
  of a fee under Subsection (a) shall set the fee in an amount that
  does not exceed the amount necessary [allows the county or
  district] to recover [at least 50 percent of] the annual
  expenditures by the county or district for:
               (1)  reviewing and acting on a permit;
               (2)  amending and renewing a permit; [and]
               (3)  inspecting a facility as provided by this chapter
  and rules adopted under this chapter; and
               (4)  otherwise administering this chapter and rules
  adopted under this chapter.
         SECTION 3.  Chapter 437, Health and Safety Code, is amended
  by adding Section 437.0124 to read as follows:
         Sec. 437.0124.  COUNTY AND PUBLIC HEALTH DISTRICT FEE
  SCHEDULE. A county or public health district shall establish a fee
  schedule for any fees collected under this chapter and revise the
  fee schedule as necessary.
         SECTION 4.  The following laws are repealed:
               (1)  Sections 437.012(g) and (h), Health and Safety
  Code; and
               (2)  Section 437.0123(c), Health and Safety Code.
         SECTION 5.  This Act takes effect September 1, 2019.
