| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 437.012(b), Health and Safety Code, is | ||
| amended to read as follows: | ||
| (b) The [ |
||
| charged by a county or public health district for issuing or | ||
| renewing a permit may not exceed the amount necessary to recover the | ||
| county's or district's cost under Subsection (d) [ |
||
| SECTION 2. Section 437.0123(b), Health and Safety Code, is | ||
| amended to read as follows: | ||
| (b) A county or public health district that requires payment | ||
| of a fee under Subsection (a) shall set the fee in an amount that | ||
| does not exceed the amount necessary [ |
||

| expenditures by the county or district for: | ||
| (1) reviewing and acting on a permit; | ||
| (2) amending and renewing a permit; [ |
||
| (3) inspecting a facility as provided by this chapter | ||
| and rules adopted under this chapter; and | ||
| (4) otherwise administering this chapter and rules | ||
| adopted under this chapter. | ||
| SECTION 3. Chapter 437, Health and Safety Code, is amended | ||
| by adding Section 437.0124 to read as follows: | ||
| Sec. 437.0124. COUNTY AND PUBLIC HEALTH DISTRICT FEE | ||
| SCHEDULE. A county or public health district shall establish a fee | ||
| schedule for any fees collected under this chapter and revise the | ||
| fee schedule as necessary. | ||
| SECTION 4. The following laws are repealed: | ||
| (1) Sections 437.012(g) and (h), Health and Safety | ||
| Code; and | ||
| (2) Section 437.0123(c), Health and Safety Code. | ||
| SECTION 5. This Act takes effect September 1, 2019. | ||
