| relating to overtime pay for child protective services employees in | ||
| the Department of Family and Protective Services. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter B, Chapter 40, Human Resources Code, | ||
| is amended by adding Section 40.03211 to read as follows: | ||
| Sec. 40.03211. OVERTIME PAY FOR CHILD PROTECTIVE SERVICES | ||
| PERSONNEL. The department may not authorize child protective | ||
| services employees to work overtime hours unless the department has | ||
| sufficient funds to fully compensate employees for the total number | ||
| of hours worked during each pay period. The department may not delay | ||
| compensation to child protective services employees for overtime | ||
| hours worked during a pay period. | ||
| SECTION 2. Immediately after the effective date of this | ||
| Act, using funds appropriated to the Department of Family and | ||
| Protective Services for the 2018-2019 fiscal biennium for the | ||
| purpose of employee compensation, the department shall reimburse | ||
| department employees who have previously worked overtime hours and | ||
| are owed compensation for those hours by the department as of the | ||
| effective date of this Act. | ||
| SECTION 3. This Act takes effect September 1, 2017. | ||
