relating to overtime pay for child protective services employees in | ||
the Department of Family and Protective Services. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter B, Chapter 40, Human Resources Code, | ||
is amended by adding Section 40.03211 to read as follows: | ||
Sec. 40.03211. OVERTIME PAY FOR CHILD PROTECTIVE SERVICES | ||
PERSONNEL. The department may not authorize child protective | ||
services employees to work overtime hours unless the department has | ||
sufficient funds to fully compensate employees for the total number | ||
of hours worked during each pay period. The department may not delay | ||
compensation to child protective services employees for overtime | ||
hours worked during a pay period. | ||
SECTION 2. Immediately after the effective date of this | ||
Act, using funds appropriated to the Department of Family and | ||
Protective Services for the 2018-2019 fiscal biennium for the | ||
purpose of employee compensation, the department shall reimburse | ||
department employees who have previously worked overtime hours and | ||
are owed compensation for those hours by the department as of the | ||
effective date of this Act. | ||
SECTION 3. This Act takes effect September 1, 2017. |
