| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter D, Chapter 38, Utilities Code, is | ||
| amended by adding Section 38.074 to read as follows: | ||
| Sec. 38.074. ROLLING BLACKOUTS. The commission by rule | ||
| shall require each electric utility, municipally owned utility, and | ||
| electric cooperative that is subject to a rolling blackout | ||
| initiated by an independent organization certified under Section | ||
| 39.151 to rotate customer curtailment so that no customer is | ||
| subject to an outage of more than 12 hours. | ||
| SECTION 2. (a) The Public Utility Commission of Texas shall | ||
| conduct a study on: | ||
| (1) methods to make the imposition of a rolling | ||
| blackout equitable across the state; and | ||
| (2) measures needed in this state to prevent the | ||
| necessity of rolling blackouts. | ||
| (b) Not later than September 1, 2022, the Public Utility | ||
| Commission of Texas shall submit to the legislature a report on the | ||
| results of the study. | ||
| SECTION 3. This Act takes effect September 1, 2021. | ||
