A BILL TO BE ENTITLED
 
AN ACT
  relating to rolling blackouts.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter D, Chapter 38, Utilities Code, is
  amended by adding Section 38.074 to read as follows:
         Sec. 38.074.  ROLLING BLACKOUTS. The commission by rule
  shall require each electric utility, municipally owned utility, and
  electric cooperative that is subject to a rolling blackout
  initiated by an independent organization certified under Section
  39.151 to rotate customer curtailment so that no customer is
  subject to an outage of more than 12 hours.
         SECTION 2.  (a) The Public Utility Commission of Texas shall
  conduct a study on:
               (1)  methods to make the imposition of a rolling
  blackout equitable across the state; and
               (2)  measures needed in this state to prevent the
  necessity of rolling blackouts.
         (b)  Not later than September 1, 2022, the Public Utility
  Commission of Texas shall submit to the legislature a report on the
  results of the study.
         SECTION 3.  This Act takes effect September 1, 2021.
