A BILL TO BE ENTITLED
 
AN ACT
  relating to establishing a minimum wage for school bus drivers.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter B, Chapter 62, Labor Code, is amended
  by adding Section 62.058 to read as follows:
         Sec. 62.058.  MINIMUM WAGE FOR SCHOOL BUS DRIVERS. (a) In
  this section, "school bus driver" means a person employed to
  transport students to or from school or a school-sponsored or
  school-related activity.
         (b)  This section applies to:
               (1)  a public school district with a student enrollment
  of 4,500 or more;
               (2)  an open-enrollment charter school; and
               (3)  a mass transit authority, commercial
  transportation company, or juvenile board that contracts with a
  school district described by Subdivision (1) or an open-enrollment
  charter school to provide public school transportation.
         (c)  Notwithstanding Section 62.051 or 62.151 or any other
  law, an employer to which this section applies shall pay to each
  school bus driver employed by the employer not less than the greater
  of:
               (1)  $15 an hour; or
               (2)  the federal minimum wage under Section 6, Fair
  Labor Standards Act of 1938 (29 U.S.C. Section 206).
         SECTION 2.  This Act takes effect September 1, 2021.
