A BILL TO BE ENTITLED
 
AN ACT
  relating to the disclosure of personal information associated with
  a motor vehicle record.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter C, Chapter 521, Transportation Code,
  is amended by adding Section 521.0501 to read as follows:
         Sec. 521.0501.  PERSONAL INFORMATION DISCLOSURE REPORT. (a)
  Not later than September 1 of each year, the department shall
  provide to the legislature, the Legislative Budget Board, and the
  state's chief data officer an annual report of all disclosures of
  personal information made by the department under this chapter that
  were subject to a fee, including the sale of information under
  Section 521.050.
         (b)  Each report must contain a description of the personal
  information that was purchased, including the format of the
  information, any field column descriptions used to categorize the
  information, and the name and address of each purchaser.
         SECTION 2.  Section 730.007(b), Transportation Code, is
  amended to read as follows:
         (b)  The only personal information an agency may release
  under this section is the [individual's]:
               (1)  individual's name and address;
               (2)  individual's date of birth; and
               (3)  last four digits of the individual's driver's
  license number.
         SECTION 3.  Section 730.013(a), Transportation Code, is
  amended to read as follows:
         (a)  An authorized recipient of personal information may not
  resell or redisclose [the] personal information [in the identical
  or a substantially identical format the personal information was]
  disclosed to the recipient by an [the applicable] agency.
         SECTION 4.  Sections 730.013(b) and (c), Transportation
  Code, are repealed.
         SECTION 5.  The repeal by this Act of Section 730.013(c),
  Transportation Code, does not affect an obligation to maintain
  records imposed under that subsection before the effective date of
  this Act. An obligation to maintain records imposed before the
  effective date of this Act is governed by the law as it existed
  immediately before the effective date of this Act, and that law is
  continued in effect for that purpose.
         SECTION 6.  The change in law made by this Act applies only
  to an offense committed on or after the effective date of this Act.
  An offense committed before the effective date of this Act is
  governed by the law in effect on the date the offense was committed,
  and the former law is continued in effect for that purpose. For
  purposes of this section, an offense was committed before the
  effective date of this Act if any element of the offense occurred
  before that date.
         SECTION 7.  This Act takes effect September 1, 2021.
