relating to the notice requirements for permits for the commercial | ||
surface disposal of oil and gas wastes. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 91.116, Natural Resources Code, is | ||
amended by amending Subsection (b) and adding Subsection (e) to | ||
read as follows: | ||
(b) A person who files an application for a permit for a | ||
commercial surface disposal facility shall provide [ |

notice of the application in accordance with this section. | ||
(e) In addition to publishing notice of the permit | ||
application as required by Subsection (d), the applicant shall give | ||
notice of the permit application to a river authority or | ||
groundwater conservation district whose territory contains the | ||
tract of land on which a disposal pit will be located or on which the | ||
disposal will take place. | ||
SECTION 2. Section 91.116, Natural Resources Code, as | ||
amended by this Act, applies only to an application for an oil and | ||
gas waste disposal permit that is filed on or after the effective | ||
date of this Act. An application for a permit filed before the | ||
effective date of this Act is governed by the law in effect on the | ||
date of filing, and that law is continued in effect for that | ||
purpose. | ||
SECTION 3. This Act takes effect September 1, 2021. |
