A BILL TO BE ENTITLED
 
AN ACT
  relating to a requirement that operators of wind power facilities
  post signs with certain identifying information.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Title 6, Utilities Code, is amended by adding
  Chapter 302 to read as follows:
  CHAPTER 302. WIND POWER FACILITY SIGNS
         Sec. 302.0101.  DEFINITIONS. In this chapter:
               (1)  "Commission" means the Public Utility Commission
  of Texas.
               (2)  "Wind power facility" has the meaning assigned by
  Section 301.0001.
         Sec. 302.0102.  POWER TO REGULATE. (a) The commission may
  regulate a wind power facility as necessary to carry out the
  commission's duties under this chapter.
         (b)  The commission may enforce the provisions of this
  chapter in the manner provided by Chapter 15 for the administrative
  enforcement of Title 2.
         Sec. 302.0103.  IDENTIFYING SIGNS REQUIRED FOR WIND POWER
  FACILITIES. An operator of a wind power facility shall post at each
  entrance to the facility a sign that:
               (1)  includes:
                     (A)  the name of the facility;
                     (B)  the name of the owner of the facility;
                     (C)  the name, business address, and phone number
  of the operator of the facility;
                     (D)  the number of acres in the lot on which the
  facility is located;
                     (E)  the county in which the sign is located; and
                     (F)  emergency contact information;
               (2)  uses contrasting colors with block letters at
  least one inch in height; and
               (3)  is displayed in a conspicuous manner clearly
  visible to the public.
         SECTION 2.  This Act takes effect September 1, 2021.
