A BILL TO BE ENTITLED
 
AN ACT
  relating to the use of local government energy savings performance
  contracts for measures that avoid expected future operating or
  maintenance costs.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 302.001(3), Local Government Code, is
  amended to read as follows:
               (3)  "Energy savings" means an estimated reduction in
  net fuel costs, energy costs, water costs, stormwater fees, other
  utility costs, or related net operating costs from or as compared to
  an established baseline of those costs, or an estimated amount of
  avoided expected future operating and maintenance costs. The term
  does not include an estimated reduction due to a decrease in energy
  rates that is not derived from increased conservation or reduced
  usage.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2017.
