A BILL TO BE ENTITLED
 
AN ACT
  relating to commercial signs along certain roads in certain
  counties.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter I, Chapter 391, Transportation Code,
  is amended by adding Section 391.2521 to read as follows:
         Sec. 391.2521.  COUNTY APPROVAL FOR CERTAIN COMMERCIAL
  SIGNS. (a)  The commissioners court of a county by order may
  require a person to obtain county approval for the construction or
  reconstruction of a commercial sign located:
               (1)  in a county that contains more than one area that
  is certified as a Dark Sky Community by the International Dark-Sky
  Association as part of the International Dark Sky Places Program;
  and
               (2)  adjacent to and visible from a farm-to-market or
  ranch-to-market road.
         (b)  The department may not issue a permit under this chapter
  to an applicant who is required to obtain county approval under this
  section unless the person has obtained the required county
  approval.
         SECTION 2.  This Act takes effect September 1, 2021.
