BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter I, Chapter 391, Transportation Code, | ||
is amended by adding Section 391.2521 to read as follows: | ||
Sec. 391.2521. COUNTY APPROVAL FOR CERTAIN COMMERCIAL | ||
SIGNS. (a) The commissioners court of a county by order may | ||
require a person to obtain county approval for the construction or | ||
reconstruction of a commercial sign located: | ||
(1) in a county that contains more than one area that | ||
is certified as a Dark Sky Community by the International Dark-Sky | ||
Association as part of the International Dark Sky Places Program; | ||
and | ||
(2) adjacent to and visible from a farm-to-market or | ||
ranch-to-market road. | ||
(b) The department may not issue a permit under this chapter | ||
to an applicant who is required to obtain county approval under this | ||
section unless the person has obtained the required county | ||
approval. | ||
SECTION 2. This Act takes effect September 1, 2021. |
