relating to certain regulations adopted by a governmental entity | ||
restricting the use of a natural gas or propane appliance or other | ||
system or component. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 3000, Government Code, is amended by | ||
adding Section 3000.0021 to read as follows: | ||
Sec. 3000.0021. CERTAIN REGULATIONS REGARDING RESTRICTION | ||
OF NATURAL GAS OR PROPANE. (a) Notwithstanding any other law, a | ||
governmental entity may not adopt or enforce a rule, charter | ||
provision, ordinance, order, or other regulation that prohibits or | ||
restricts, directly or indirectly, the use of an appliance or other | ||
system or component that is fueled by natural gas or propane in the | ||
construction, renovation, maintenance, or alteration of a | ||
residential or commercial building. | ||
(b) A rule, charter provision, ordinance, order, or other | ||
regulation adopted by a governmental entity that conflicts with | ||
this section is void. | ||
SECTION 2. This Act takes effect September 1, 2021. |
