A BILL TO BE ENTITLED
 
AN ACT
  relating to restricting salary increases and bonuses given to the
  administrative head of certain state agencies.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 659.021, Government Code, is amended to
  read as follows:
         Sec. 659.021.  ADMINISTRATIVE HEAD OF AGENCY. (a) The
  administrative head of a state agency as defined by Section 658.001
  whose salary as administrative head is established by the General
  Appropriations Act may not receive a salary higher than that
  established salary, even if the administrative head performs duties
  assigned to a position title classified in the state's position
  classification plan that is assigned to a salary group that would
  pay a higher salary, unless the General Appropriations Act
  specifically provides that a higher salary may be received.
         (b)  The governing body of a state agency required to comply
  with Section 2161.123 may not provide a salary increase or bonus of
  any type in a state fiscal year to the administrative head of the
  state agency unless the agency met the agency's goals established
  under Section 2161.123(d)(5) for contracting with historically
  underutilized businesses during the preceding state fiscal year.
         SECTION 2.  This Act takes effect September 1, 2017.
