BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 209.014(a), Property Code, is amended to | ||
read as follows: | ||
(a) Notwithstanding any provision in a dedicatory | ||
instrument, a board of a property owners' association shall call an | ||
annual meeting of the members of the association. An annual meeting | ||
may be held by any method of communication, including electronic or | ||
telephonic means as described by Section 6.002, Business | ||
Organizations Code, provided that: | ||
(1) each person in attendance at the meeting may hear | ||
and be heard by every other person at the meeting; and | ||
(2) the notice of the meeting sent to members of the | ||
association includes instructions to access any communication | ||
method required to attend the meeting remotely. | ||
SECTION 2. Section 209.00592(a-1), Property Code, is | ||
amended to read as follows: | ||
(a-1) Except as provided by this subsection, [ |

association is not required to provide an owner with more than one | ||
voting method. An owner must be allowed to vote by one of the | ||
following voting methods: | ||
(1) absentee ballot; | ||
(2) [ |

(3) electronic ballot. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2021. |
