relating to the establishment of the Neurodegenerative Disease | ||
Advisory Committee. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 154.001, Education Code, is amended to | ||
read as follows: | ||
Sec. 154.001. DEFINITIONS [ |
||
(1) "Advisory committee" means the Neurodegenerative | ||
Disease Advisory Committee. | ||
(2) "Council[ |
||
Alzheimer's Disease and Related Disorders. | ||
SECTION 2. Chapter 154, Education Code, is amended by | ||
adding Section 154.0045 to read as follows: | ||
Sec. 154.0045. NEURODEGENERATIVE DISEASE ADVISORY | ||
COMMITTEE. (a) The council shall establish the Neurodegenerative | ||
Disease Advisory Committee to: | ||
(1) support the consortium of Alzheimer's disease | ||
centers through the council's Darrell K Royal Texas Alzheimer's | ||
Initiative in: | ||
(A) discovering the causes of Alzheimer's | ||
disease and other neurodegenerative diseases in humans; | ||
(B) developing cures for those diseases; and | ||
(C) establishing programs to address access to | ||
advanced treatment of Alzheimer's disease; and | ||
(2) establish appropriate standards consistent with | ||
the powers and duties of the consortium under this chapter to ensure | ||
the proper use of money authorized for Alzheimer's disease | ||
research, facilities development, and caregiver resources. | ||
(b) The advisory committee is composed of the following nine | ||
members: | ||
(1) one member appointed by the governor who is a | ||
member of the Board of Advisors for the Darrell K Royal Research | ||
Fund for Alzheimer's Disease; | ||
(2) four members appointed by the lieutenant governor; | ||
and | ||
(3) four members appointed by the speaker of the house | ||
of representatives. | ||
(c) In appointing members to the advisory committee under | ||
Subsections (b)(2) and (3), the lieutenant governor and the speaker | ||
of the house of representatives must each appoint: | ||
(1) three individuals who are physicians or scientists | ||
with extensive experience in the field of Alzheimer's disease and | ||
neurology, including at least one individual who represents a | ||
nationally designated Alzheimer's disease research center funded | ||
by the National Institute on Aging; and | ||
(2) one member of the public. | ||
(d) The member appointed by the governor under Subsection | ||
(b)(1) serves as chair of the advisory committee. | ||
(e) The members of the advisory committee serve staggered | ||
three-year terms. The appointing authorities shall appoint the | ||
initial member to terms of one, two, and three years as necessary to | ||
ensure one-third of the appointed members' terms expire each year. | ||
(f) The members of the advisory committee serve at the | ||
pleasure of the appointing authority. | ||
(g) If a vacancy occurs on the advisory committee, the | ||
appropriate appointing authority shall appoint a successor in the | ||
same manner as the original appointment to serve for the remainder | ||
of the unexpired term. The appropriate appointing authority shall | ||
appoint the successor not later than the 30th day after the date the | ||
vacancy occurs. | ||
(h) The council shall hire personnel as necessary to support | ||
the advisory committee in fulfilling its duties under this chapter. | ||
(i) Section 2110.008, Government Code, does not apply to the | ||
advisory committee. | ||
SECTION 3. Not later than March 1, 2024, the governor, | ||
lieutenant governor, and speaker of the house of representatives | ||
shall appoint members of the Neurodegenerative Disease Advisory | ||
Committee established under Section 154.0045, Education Code, as | ||
added by this Act. | ||
SECTION 4. This Act takes effect on the 91st day after the | ||
last day of the legislative session. |
