during a state of disaster. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 39.160, Utilities Code, as added by S.B. | ||
3, Acts of the 87th Legislature, Regular Session, 2021, is amended | ||
by adding Subsection (h) to read as follows: | ||
(h) Notwithstanding any other provision of this section, | ||
during a state of disaster declared by the governor under Chapter | ||
418, Government Code, in response to an extreme weather event, the | ||
commission may not by order raise the wholesale price of electric | ||
energy sold in the ERCOT power region for the purpose of correcting | ||
the price of electric energy to match the demand for electric | ||
energy. | ||
SECTION 2. This Act takes effect on the 91st day after the | ||
last day of the legislative session. |
