relating to including in the annual report of a local school health | ||
advisory council to a school district board of trustees information | ||
related to funding of programs designed to promote improved student | ||
health. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 28.004(m), Education Code, is amended to | ||
read as follows: | ||
(m) In addition to performing other duties, the local school | ||
health advisory council shall submit to the board of trustees, at | ||
least annually, a written report that includes: | ||
(1) any council recommendation concerning the school | ||
district's health education curriculum and instruction or related | ||
matters that the council has not previously submitted to the board; | ||
(2) any suggested modification to a council | ||
recommendation previously submitted to the board; [ |

(3) a detailed explanation of the council's activities | ||
during the period between the date of the current report and the | ||
date of the last prior written report; | ||
(4) a determination of the funding necessary to | ||
implement and operate: | ||
(A) a coordinated health program described by | ||
Section 38.013; and | ||
(B) any required state or federal health program | ||
related to student nutrition and physical fitness; and | ||
(5) an analysis of the expenditure of funds received | ||
by the district for a program under Subdivision (4). | ||
SECTION 2. This Act applies beginning with the 2011-2012 | ||
school year. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2011. |
