HB3985 by Huberty (Relating to the offense of providing an alcoholic beverage to a minor; increasing a criminal penalty.), As Introduced

No significant fiscal implication to the State is anticipated.

This bill would amend the Alcoholic Beverage Code to increase the punishment for purchasing or giving an alcoholic beverage to a minor from a Class A misdemeanor to a third degree felony if the minor dies as a result of the consumption of the alcoholic beverage.

Based on analysis by the Office of Court Administration and the Texas Alcoholic Beverage Commission, it is assumed that the duties and responsibilities associated with implementing the bill could be accomplished using existing resources.  

Based on the analysis of the Comptroller, the bill could result in an increase in criminal penalty revenue; however, the amount of the increases cannot be estimated. 

This analysis assumes the provisions of the bill addressing felony sanctions for criminal offenses would not result in a significant impact on state correctional agencies.

Local Government Impact

According to the Texas Association of Counties, no significant fiscal impact to counties is anticipated.
