LEGISLATIVE BUDGET BOARD

FISCAL NOTE, 87TH LEGISLATIVE REGULAR SESSION

March 28, 2021

TO:
Honorable Victoria Neave, Chair, House Committee on Juvenile Justice & Family Issues

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB2536 by Krause (Relating to neglect of a child and the grounds for termination of the parent-child relationship and possession of a child by the Department of Family and Protective Services.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend Family Code to prohibit a court from making certain findings and ordering termination of the parent-child relationship and prohibit the Department of Family and Protective Services (DFPS) from taking possession of a child based on evidence that the parent sought an opinion from more than one medical provider relating to the child's medical care, transferred the child's medical care to a new medical provider, or transferred the child to another health care facility.

Based on analysis of DFPS and the Office of Court Administration, it is assumed that the costs associated with implementing the provisions of the bill could be absorbed within existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
