Amend Amendment No. 1 by Hancock to HB 4492 in SECTION 5 of the bill as proposed by the amendment, in added Subchapter N, Chapter 39, Utilities Code, following added Section 39.661 (page 19, between lines 7 and 8), by inserting the following:
Sec. 39.662. LEGAL ACTIONS INVOLVING PRICING OR UPLIFT ACTIONS. A load-serving entity that receives financial assistance under this subchapter may not initiate, pursue, or continue a legal action that seeks judicial review of pricing or uplift actions taken by the commission or the independent organization certified under Section 39.151 for the ERCOT power region in connection with the period of emergency.
