| AN ACT |
| |
1 | Amending the act of December 18, 2007 (P.L.486, No.77), entitled |
2 | "An act providing for the Hazardous Sites Cleanup Fund, for |
3 | its funding, for expenditures from the fund and for audits of |
4 | the fund; making an appropriation; and making related |
5 | repeals," providing for deposit of funds; and further |
6 | providing for annual reports. |
7 | The General Assembly of the Commonwealth of Pennsylvania |
8 | hereby enacts as follows: |
9 | Section 1. The act of December 18, 2007 (P.L.486, No.77), |
10 | known as the Hazardous Sites Cleanup Funding Act, is amended by |
11 | adding a section to read: |
12 | Section 4.1. Deposit to fund. |
13 | In addition to money from sources set forth under section |
14 | 901(c) of the act of October 18, 1988 (P.L.756, No.108), known |
15 | as the Hazardous Sites Cleanup Act, all civil penalties and | <-- |
16 | criminal penalties, response costs and natural resources damages |
17 | assessed under section 1104 of the Hazardous Sites Cleanup Act | <-- |
18 | shall be deposited into the fund. |
19 | Section 2. Section 6 of the act is amended to read: |
20 | Section 6. Annual report. |

1 | (a) Submission and posting.--The annual report required |
2 | under section 902(c) of the act of October 18, 1988 (P.L.756, |
3 | No.108), known as the Hazardous Sites Cleanup Act, shall be |
4 | transmitted by the department to the General Assembly no later |
5 | than [August] December 31 of each year. The annual report may be |
6 | submitted to the General Assembly via electronic mail. The |
7 | department shall also publish and maintain the annual report on |
8 | the department's publicly accessible Internet website. |
9 | (b) Contents.--In addition to the information required to be |
10 | submitted under section 902(c) of the Hazardous Sites Cleanup |
11 | Act, the annual report shall also contain, at a minimum, the |
12 | following information: |
13 | (1) The number and a description of the emergency |
14 | responses initiated by the department and the costs incurred |
15 | in the aggregate and for each emergency response. |
16 | (2) The number and nature of violations of the Hazardous |
17 | Sites Cleanup Act and the amount of fines and penalties |
18 | assessed in the aggregate and for each violation. |
19 | (3) The amount expended for personnel costs. |
20 | Section 3. This act shall take effect in 60 days. |
