| AN ACT |
| |
1 | Amending Title 4 (Amusements) of the Pennsylvania Consolidated |
2 | Statutes, further providing for license or permit application |
3 | hearing process and public input hearings. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 1205 of Title 4 of the Pennsylvania |
7 | Consolidated Statutes is amended by adding a subsection to read: |
8 | § 1205. License or permit application hearing process; public |
9 | input hearings. |

11 | (c) Referendum.-- |
12 | (1) The board may not license a facility under this part |
13 | unless a majority of the electors voting on the question |
14 | required under this subsection vote in the affirmative. |
15 | (2) Following the conclusion of all public hearings held |
16 | under subsection (a), the municipality where the facility |
17 | will be located shall place a question on the ballot at the |
18 | next municipal election. |

1 | (3) The referendum question must state that a facility |
2 | is proposed for the electors' municipality and that the board |
3 | may only issue a license if a majority of the electors voting |
4 | on the question approve. The question shall be in clear |
5 | language that is readily understandable by a layperson. |
6 | (4) Proceedings under this subsection shall be in |
7 | accordance with the provisions of the act of June 3, 1937 |
8 | (P.L.1333, No.320), known as the Pennsylvania Election Code. |
9 | Section 2. The addition of 4 Pa.C.S. § 1205(c) shall apply |
10 | to any slot machine license application filed on or after the |
11 | effective date of this section. |
12 | Section 3. This act shall take effect immediately. |
