| AN ACT |
| |
1 | Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An |
2 | act relating to the public school system, including certain |
3 | provisions applicable as well to private and parochial |
4 | schools; amending, revising, consolidating and changing the |
5 | laws relating thereto," in professional employees, further |
6 | providing for definitions; and providing for school social | <-- |
7 | workers. |
8 | The General Assembly of the Commonwealth of Pennsylvania |
9 | hereby enacts as follows: |
10 | Section 1. Section 1101 1101(1) of the act of March 10, 1949 | <-- |
11 | (P.L.30, No.14), known as the Public School Code of 1949, |
12 | amended November 30, 1971 (P.L.546, No.144), is amended to read: |
13 | Section 1101. Definitions.--As used in this article, |
14 | (1) The term "professional employe" shall include those who |
15 | are certificated as teachers, supervisors, supervising |
16 | principals, principals, assistant principals, vice-principals, |
17 | directors of vocational education, dental hygienists, visiting |
18 | teachers, home and school visitors, school social workers, |
19 | school counselors, child nutrition program specialists, school |
20 | librarians, school secretaries the selection of whom is on the |

1 | basis of merit as determined by eligibility lists and school |
2 | nurses. |
3 | (1.1) The term "school social worker" shall include those | <-- |
4 | who hold a license in good standing as a licensed social worker |
5 | or a licensed clinical social worker in accordance with the act |
6 | of July 9, 1987 (P.L.220, No.39), known as the "Social Workers, |
7 | Marriage and Family Therapists and Professional Counselors Act," |
8 | and are certificated to practice clinical social work, marriage |
9 | and family therapy, professional counseling, social work and |
10 | social work methods and theory application as defined by that |
11 | act. |
12 | (2) The term "substitute" shall mean any individual who has |
13 | been employed to perform the duties of a regular professional |
14 | employe during such period of time as the regular professional |
15 | employe is absent on sabbatical leave or for other legal cause |
16 | authorized and approved by the board of school directors or to |
17 | perform the duties of a temporary professional employe who is |
18 | absent. |
19 | (3) The term "temporary professional employe" shall mean any |
20 | individual who has been employed to perform, for a limited time, |
21 | the duties of a newly created position or of a regular |
22 | professional employe whose services have been terminated by |
23 | death, resignation, suspension or removal. |

25 | Section 2. The act is amended by adding a section to read: |
26 | Section 1107.1. School Social Workers.--(a) A school entity |
27 | may employ school social workers who meet the qualifications set |
28 | forth in the act of July 9, 1987 (P.L.220, No.39), known as the |
29 | "Social Workers, Marriage and Family Therapists and Professional |
30 | Counselors Act." |

1 | (b) Social workers who meet the qualifications of the |
2 | "Social Workers, Marriage and Family Therapists and Professional |
3 | Counselors Act," including an individual employed as a school |
4 | social worker in a public or private school in this Commonwealth |
5 | on or before the effective date of this section, shall be deemed |
6 | qualified by the Department of Education to perform the services |
7 | outlined in that act in a school entity. |
8 | (c) A social worker performing services in a school entity |
9 | may work under the supervision of a superintendent, assistant |
10 | superintendent or other school administrator or employe as |
11 | determined by the school entity. |
12 | (d) For the purposes of this section, the term "school |
13 | entity" shall mean any public school district, intermediate |
14 | unit, charter school or area vocational-technical school. |
