| AN ACT |
| |
1 | Providing for an extension of approvals granted by a government |
2 | agency during the period beginning after December 31, 2008, |
3 | and ending before July 2, 2011. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Short title. |
7 | This act shall be known and may be cited as the Building | <-- |
8 | Development Permit Extension Act. | <-- |
9 | Section 2. Definitions. |
10 | The following words and phrases when used in this act shall |
11 | have the meanings given to then in this section unless the |
12 | context clearly indicates otherwise: |
13 | "Approval." An authorization granted by a government agency | <-- |
14 | in the form of a permit, approval, license, certification, |
15 | permission, determination, exemption, variance, exception, |
16 | waiver, letter of interpretation or agreement that allows a |
17 | development or construction project to proceed. |

1 | "Approval." Any government agency approval, license, permit, | <-- |
2 | certificate, variance, waiver, interpretation, determination, |
3 | exemption, exception, no further action letter, agreement or |
4 | other authorization or decision: |
5 | (1) allowing a development or construction project to |
6 | proceed; or |
7 | (2) relating to or affecting development, granted |
8 | pursuant to a statute or regulation, including the following: |
9 | (i) 37 Pa.C.S. (relating to historical and museums). |
10 | (ii) 53 Pa.C.S. (relating to municipalities |
11 | generally). |
12 | (iii) 68 Pa.C.S. Pt. II, Subpt. D (relating to |
13 | planned communities). |
14 | (iv) The act of June 13, 1836 (P.L.551, No.169), |
15 | referred to as the General Road Law. |
16 | (v) The act of April 27, 1927 (P.L.465, No.299), |
17 | referred to as the Fire and Panic Act. |
18 | (vi) The act of April 9, 1929 (P.L.177, No.175), |
19 | known as The Administrative Code of 1929. |
20 | (vii) The act of June 23, 1931 (P.L.932, No.317), |
21 | known as The Third Class City Code. |
22 | (viii) The act of June 24, 1931 (P.L.1206, No.331), |

30 | (xxvi) Soil erosion and sediment control plans |

1 | granted by a local soil conservation district under 25 |
2 | Pa. Code Ch. 102 (relating to erosion and sediment |
3 | control). |
4 | (xxvii) The National Historic Preservation Act |
5 | (Public Law 89-665, 80 Stat. 915), to the extent the |
6 | Commonwealth has been empowered to administer, approve or |
7 | otherwise authorize activities under that act. |
8 | (xxviii) The Federal Water Pollution Control Act (62 |
9 | Stat. 1155, 33 U.S.C. § 1251 et seq.), to the extent the |
10 | Commonwealth has been empowered to administer, approve or |
11 | otherwise authorize activities under that act. |
12 | "Development." Any of the following: |
13 | (1) The division of a parcel of land into two or more |
14 | parcels, including a subdivision as defined in section 107 of | <-- |
15 | the act of July 31, 1968 (P.L.805, No.247), known as the |
16 | Pennsylvania Municipalities Planning Code. |
17 | (2) The construction, reconstruction, conversion, |
18 | structural alteration, relocation or enlargement of a |
19 | building or other structure or facility. |
20 | (3) Grading, soil removal, relocation, excavation or | <-- |
21 | landfill. |
22 | (3) Site preparation, including grading, earth moving | <-- |
23 | activities, demolition and clearance, soil removal, timber |
24 | harvesting relocation, excavation, landfill and moving, |
25 | depositing or storing soil, rock or earth materials. |
26 | (4) A use or change in the use of a building or other |
27 | structure or change in land use. |
28 | (5) Land development as defined in section 107 of the | <-- |
29 | Pennsylvania Municipalities Planning Code. |
30 | "Extension period." The period beginning after December 31, |

1 | 2008, and ending before July 2, 2011 2013. | <-- |
2 | "Government agency." An agency, department, commission or | <-- |
3 | board of the Commonwealth or of a political subdivision of the |
4 | Commonwealth. The term includes regional commissions, boards or |
5 | other instrumentalities The Commonwealth, a political | <-- |
6 | subdivision or an agency, department, commission or board of the |
7 | Commonwealth or a political subdivision. The term includes |
8 | regional commissions, boards or instrumentalities with the |
9 | authority to issue approvals. |
10 | Section 3. Existing approval. |
11 | (a) Automatic suspension.--The expiration date of an |
12 | approval by a government agency relating to development that is |
13 | granted for or in effect during the extension period, whether | <-- |
14 | obtained before or after the beginning of the extension period, |
15 | shall be automatically suspended during the extension period. |
16 | The automatic suspension of the expiration of an approval under |
17 | this section shall not extend the approval for more than six |
18 | months beyond the conclusion of the extension period. |
19 | (b) Duration.--Nothing in this section shall shorten the |
20 | term or duration an approval relating to development would have | <-- |
21 | had in the absence of the enactment of this section. Nothing in |
22 | this section shall prohibit the granting of additional |
23 | extensions as provided by law. |
24 | Section 4. Subsequent changes. | <-- |
25 | (a) Change in law.--A law, regulation or policy enacted or |
26 | adopted by a government agency during the extension period shall |
27 | not have the effect of prohibiting or limiting an approval |
28 | during the extension period. |
29 | (b) Planning code approval.--When an approval has been |
30 | granted under section 508 of the act of July 31, 1968 (P.L.805, |

1 | No.247), known as the Pennsylvania Municipalities Planning Code, |
2 | a subsequent change in a zoning, subdivision or other governing |
3 | ordinance or plan shall not apply to or affect the right of the |
4 | applicant to commence or complete the activities authorized by |
5 | the approval for the duration of the extension period. For |
6 | purposes of this subsection, the extension period shall be |
7 | extended for the duration of any litigation, including appeals, |
8 | relating to an approval which prevents the completion of all or |
9 | part of the activity authorized by the approval. |
10 | (c) Nonexpiration.--An action by a government agency or law |
11 | to lease, license, grant or otherwise convey rights in the beds |
12 | of navigable waters of the Commonwealth shall not expire for the |
13 | duration of the extension period, including time limits relating |
14 | to the initiation, prosecution or completion of construction. A |
15 | conveyance of rights under this subsection shall not terminate |
16 | for failure to initiate, prosecute or complete construction. |
17 | Section 5. Agency verification. |
18 | (a) Request for verification.-- |
19 | (1) The holder or recipient of an approval may seek |
20 | written verification from the issuing government agency for |
21 | any of the following: |
22 | (i) The existence of a valid approval. |
23 | (ii) The expiration date of the approval under this |
24 | act. |
25 | (2) The request shall set forth the approval in question |
26 | and the anticipated expiration date under this act. |
27 | (b) Agency action.--Upon receipt of a request under |
28 | subsection (a), the government agency shall respond in writing, |
29 | affirming or denying the existence of the approval, its |
30 | expiration date and any issues associated with its validity |

1 | within 30 days of receipt of the request. Failure to respond |
2 | within 30 days shall result in a deemed affirmation of the |
3 | existence of the approval and expiration date set forth in the |
4 | request submitted under subsection (a). The agency may charge a |
5 | fee of not more than $100 for verification of a residential |
6 | approval and $500 for verification of a commercial approval |
7 | under this subsection. |
8 | (c) Failure to seek affirmation.--The failure of the holder |
9 | of an approval to seek verification from a government agency |
10 | shall not be grounds for termination, revocation or other |
11 | invalidation of an approval. |
12 | Section 4 6. Applicability. | <-- |
13 | This act shall not apply to any of the following: |
14 | (1) An approval issued by an agency of the United States |
15 | or an approval issued the duration of which is specified or |
16 | determined by Federal law or regulation. |
17 | (2) An approval issued by the Department of | <-- |
18 | Transportation. |
19 | (3) An administrative consent order or other enforcement |
20 | action by the Department of Environmental Protection. | <-- |
21 | relating to an individual approval that is subject to the | <-- |
22 | extension period. |
23 | (3) An approval, designation or benefit under the act of |
24 | October 6, 1998 (P.L.705, No.92), known as the Keystone |
25 | Opportunity Zone, Keystone Opportunity Expansion Zone and |
26 | Keystone Opportunity Improvement Zone Act. |
27 | (4) A "One-Call" determination, response or other |
28 | requirement under the act of December 10, 1974 (P.L.852, |
29 | No.287), referred to as the Underground Utility Line |
30 | Protection Law. |

1 | (5) The revocation or modification of an approval or |
2 | extension of an approval, when the approval authorizes the |
3 | modification or revocation for cause. |
4 | (6) If an approval is based upon the connection to a |
5 | sanitary sewer system or water distribution system, the |
6 | application of the extension period shall be contingent upon |
7 | the availability of sufficient capacity of the system to |
8 | accommodate the development that is the subject of the |
9 | extended approval. If sufficient capacity is unavailable, the |
10 | holder of a permit that is subject to the extension period |
11 | shall have priority with regard to further allocation of |
12 | capacity over the holder of a permit that receives approval |
13 | after the effective date of this act. Priority relating to |
14 | distribution of additional capacity shall be allocated in |
15 | order of the granting of the original approval for the |
16 | connection. |
17 | Section 7. Notice. |
18 | Within 30 days of the effective date of this section, each |
19 | affected Commonwealth agency shall publish notice of |
20 | applicability of the extension period to approvals granted by |
21 | the Commonwealth agency under this act in the Pennsylvania |
22 | Bulletin. |
23 | Section 8. Miscellaneous. |
24 | Nothing in this act shall be construed to modify any |
25 | requirement of law that is necessary to retain Federal |
26 | delegation to, or assumption by, the Commonwealth of the |
27 | authority to implement a Federal law or program. |
28 | Section 20. Effective date. |
29 | This act shall take effect in 60 days. |
