| AN ACT |
| |
1 | Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An |
2 | act relating to the public school system, including certain |
3 | provisions applicable as well to private and parochial |
4 | schools; amending, revising, consolidating and changing the |
5 | laws relating thereto," in duties and powers of boards of |
6 | school directors, further providing for majority vote |
7 | required and recording. |
8 | The General Assembly of the Commonwealth of Pennsylvania |
9 | hereby enacts as follows: |
10 | Section 1. Section 508 of the act of March 10, 1949 (P.L.30, |
11 | No.14), known as the Public School Code of 1949, amended January |
12 | 14, 1970 (1969 P.L.468, No.192), is amended to read: |
13 | Section 508. Majority Vote Required; Recording.--The |
14 | affirmative vote of a majority of all the members of the board |
15 | of school directors in every school district, duly recorded, |
16 | showing how each member voted, shall be required in order to |
17 | take action on the following subjects:-- |
18 | Fixing length of school term. |
19 | Adopting textbooks. |
20 | Appointing or dismissing district superintendents, assistant |

1 | district superintendents, associate superintendents,principals, |
2 | and teachers. |
3 | Appointing tax collectors and other appointees. |
4 | Adopting the annual budget. |
5 | Levying and assessing taxes, including any actions taken by |
6 | the board of school directors or the school district to initiate |
7 | an appeal to increase or decrease the assessed value of any real |
8 | property located within the school district. A separate vote | <-- |
9 | must be taken for each property that the board of school |
10 | directors or school district is seeking to have reassessed. The |
11 | owner, address and tax parcel number of the property, as well as |
12 | the appraisal method used by the school district to determine |
13 | the value of the property, shall be clearly identified and | <-- |
14 | listed separately and made public thirty (30) days prior to the |
15 | vote. The owner of the affected property shall be notified |
16 | thirty (30) days prior to the vote. The superintendent, business | <-- |
17 | manager or one of the members elected to the board of directors |
18 | of that school district must attend all proceedings regarding |
19 | each appeal and be seated with the chosen representative of the |
20 | corporate authority at any appeal proceeding. |
21 | Purchasing, selling, or condemning land. |
22 | Locating new buildings or changing the locations of old ones. |
23 | Dismissing a teacher after a hearing. |
24 | Creating or increasing any indebtedness. |
25 | Adopting courses of study. |
26 | Establishing additional schools or departments. |
27 | Designating depositories for school funds. |
28 | Entering into contracts of any kind, including contracts for |
29 | the purchase of fuel or any supplies, where the amount involved |
30 | exceeds one hundred dollars ($100). |

1 | Fixing salaries or compensation of officers, teachers, or |
2 | other appointees of the board of school directors. |
3 | Entering into contracts with and making appropriations to the |
4 | intermediate unit for the district's proportionate share of the |
5 | cost of services provided or to be provided for by the |
6 | intermediate unit. |
7 | Failure to comply with the provisions of this section shall |
8 | render such acts of the board of school directors void and |
9 | unenforcible. |
10 | Section 2. This act shall take effect in 60 days. |
