AN ACT

 

1Amending Title 42 (Judiciary and Judicial Procedure) of the
2Pennsylvania Consolidated Statutes, in officers serving
3process and enforcing orders, providing for municipal police.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1.  Chapter 29 of Title 42 of the Pennsylvania
7Consolidated Statutes is amended by adding a subchapter to read:

8SUBCHAPTER D

9MUNICIPAL POLICE

10Sec.

112961.  Municipal police.

12§ 2961.  Municipal police.

13(a)  Fee.--If a municipal police officer executes one or more
14warrants or effectuates the payment of fines and costs by
15attempting to execute one or more warrants, the fee for such
16service shall be $35 per defendant.

17(b)  Payment.--The fee shall be borne by the defendant. The
18fee shall be collected as provided by law for court costs. Once

1collected, the fee shall be remitted to the municipality which
2provided the service or to the Commonwealth if no municipal
3police department exists for the municipality.

4(c)  Definition.--As used in this section, the term 
5"municipal police officer" shall include the Pennsylvania State 
6Police where no municipal police department exists.

7Section 2.  This act shall take effect in 60 days.
