| AN ACT |
| |
1 | Amending Title 42 (Judiciary and Judicial Procedure) of the |
2 | Pennsylvania Consolidated Statutes, in post-trial matters, |
3 | further providing for jurisdiction and proceedings. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 9545(b)(2) of Title 42 of the |
7 | Pennsylvania Consolidated Statutes is amended and the subsection |
8 | is amended by adding a paragraph to read: |
9 | § 9545. Jurisdiction and proceedings. |

11 | (b) Time for filing petition.-- |
12 | * * * |
13 | (2) Any petition invoking an exception provided in |
14 | paragraph (1) shall be filed within [60 days] one year of the |
15 | date the claim could have been presented. |

17 | (5) Notwithstanding any other provision of law, any |
18 | petition filed under this subchapter alleging a miscarriage |

1 | of justice that lead to the conviction of a person who was |
2 | factually innocent of the crime for which the person was |
3 | convicted, in light of all the credible evidence available at |
4 | and subsequent to trial, may be filed at any time. |
