| AN ACT |
| |
1 | Establishing a temporary oversight council to analyze and report |
2 | to the General Assembly regarding the utilization of Federal |
3 | Stimulus funding in Pennsylvania. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Short title. |
7 | This act shall be known and may be cited as the Federal |
8 | Stimulus Funding Oversight Council Act. |
9 | Section 2. Council established. |
10 | (a) Establishment.--The Federal Stimulus Funding Oversight |
11 | Council is established. |
12 | (b) Members.--The council shall consist of nine members to |
13 | be appointed as follows: |
14 | (1) Four legislative appointments: |
15 | (i) one from the Senate Democratic Caucus; |

1 | (ii) one from the Senate Republican Caucus; |
2 | (iii) one from the House Democratic Caucus; and |
3 | (iv) one from the House Republican Caucus. |
4 | Each member shall be appointed by his respective caucus |
5 | leader. |
6 | (2) A person appointed by the Governor. |
7 | (3) A person appointed to represent school districts. |
8 | (4) A person appointed to represent local governments. |
9 | (5) A person appointed to represent organized labor. |
10 | (6) A person appointed to represent the Pennsylvania |
11 | Chamber of Business and Industry. |
12 | (c) Nonlegislative appointments.--The nonlegislative |
13 | appointments referred to in subsection (b) shall be made by the |
14 | Governor and shall not require the advice and consent of the |
15 | Senate. |
16 | Section 3. Duties of council. |
17 | The Federal Stimulus Funding Oversight Council shall have the |
18 | following specific duties: |
19 | (1) to study, analyze and report on the degree of |
20 | transparency to taxpayers and other government officials in |
21 | the distribution and utilization of funds pursuant to the |
22 | American Recovery and Reinvestment Act of 2009 (Public Law |
23 | 111-5, 123 Stat. 115); |
24 | (2) to study, analyze and report on the scope, amount |
25 | and nature of job growth in this Commonwealth under the |
26 | American Recovery and Reinvestment Act of 2009; |
27 | (3) to study, analyze and report on the scope and nature |
28 | of other economic activity that occurs in this Commonwealth |
29 | under the American Recovery and Reinvestment Act of 2009; |
30 | (4) to study, analyze and report on the long-term impact |

1 | on State spending as a result of the utilization of funds in |
2 | this Commonwealth under the American Recovery and |
3 | Reinvestment Act of 2009; and |
4 | (5) to study, analyze and report on the regulatory and |
5 | administrative impediments to the utilization of funds in |
6 | this Commonwealth under the American Recovery and |
7 | Reinvestment Act of 2009. |
8 | Section 4. Internet website. |
9 | The Federal Stimulus Funding Oversight Council shall |
10 | establish an Internet website to make available to the public |
11 | information on the utilization of any funds under the American |
12 | Recovery and Reinvestment Act of 2009 (Public Law 111-5, 123 |
13 | Stat. 115). |
14 | Section 5. Interagency cooperation. |
15 | All government agencies receiving funds from the American |
16 | Recovery and Reinvestment Act of 2009 (Public Law 111-5, 123 |
17 | Stat. 115) shall cooperate with the Federal Stimulus Funding |
18 | Oversight Council in the fulfillment of the duties of the |
19 | council as required by this act. |
20 | Section 6. Expiration. |
21 | This act shall expire on February 17, 2012. |
22 | Section 7. Effective date. |
23 | This act shall take effect immediately. |
