AN ACT

Amending the act of August 15, 1961 (P.L.987, No.442), entitled

2

"An act relating to public works contracts; providing for

3

prevailing wages; imposing duties upon the Secretary of Labor

4

and Industry; providing remedies, penalties and repealing

5

existing laws," providing for duty of contractor on school

6

construction project.

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

9

Section 1.  The act of August 15, 1961 (P.L.987, No.442),

10

known as the Pennsylvania Prevailing Wage Act, is amended by

11

adding a section to read:

Section 6.1.  Duty of Contractor on School Construction

13

Project.--(a)  Notwithstanding section 6, a contractor or

14

subcontractor performing public work under a contract with a

15

school district shall certify that each employe of the

16

contractor or subcontractor working at the school construction

17

site has complied with section 111 of the act of March 10, 1949

18

(P.L.30, No.14), known as the "Public School Code of 1949." The

records indicating certification of compliance shall be

2

submitted to the school district and the department.

(b)  A contractor shall ensure that its employes wear at all

4

times while on a school construction site an identification

5

badge exhibiting that the employe is in compliance with the

6

requirements of subsection (a). The identification badge shall

7

display the following information:

8

(1)  the person's full name;

9

(2)  clear indication that the person is in compliance with

10

subsection (a); and

11

(3)  a current photograph of the person's face.

12

(c)  No contractor, subcontractor or employe of a contractor

13

or subcontractor may be granted access to a school construction

14

site unless the person is wearing the identification badge

15

required under subsection (b).

16

(d)  In the event that the department shall determine, after

17

notice and hearing as required under this act, that a contractor

18

or subcontractor knowingly or willfully failed to comply with

19

the requirements of this section, the department shall notify

20

all school districts of the name of the contractor or

21

subcontractor, and no contract may be awarded to the contractor

22

or subcontractor or to any firm, corporation or partnership in

23

which the contractor or subcontractor has an interest until

24

three years have elapsed from the date of the notice to the

25

school districts or may assess a civil penalty not to exceed two

26

thousand five hundred dollars ($2,500), or both.

27

Section 2.  This act shall take effect in 60 days.
