| AN ACT |
| |
1 | Amending Title 18 (Crimes and Offenses) of the Pennsylvania |
2 | Consolidated Statutes, further providing for the offense of |
3 | gasoline price hiking. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Title 18 of the Pennsylvania Consolidated |
7 | Statutes is amended by adding a section to read: |
8 | § 7332. Gasoline price hiking. |
9 | (a) Offense defined.--A person who owns or operates a |
10 | gasoline retail establishment and raises the price of a gallon |
11 | of gasoline more than once in a 24-hour period commits an |
12 | offense. |
13 | (b) Penalty.--A person who violates this section commits: |
14 | (1) For a first violation, a summary offense and shall, |
15 | upon conviction, be sentenced to pay a fine of not less than |
16 | $250 nor more than $1,000. |
17 | (2) For a second or subsequent violation, a misdemeanor |

1 | of the third degree and shall, upon conviction, be sentenced |
2 | to pay a fine of not less than $1,000 nor more than $5,000 or |
3 | to imprisonment for not more than 90 days, or both. |
4 | (c) Definitions.--As used in this section, the following |
5 | words and phrases shall have the meanings given to them in this |
6 | subsection: |
7 | "Gasoline." Fuels, liquid fuels and diesel fuels as defined |
8 | under 75 Pa.C.S. § 9002 (relating to definitions). |
9 | "Gasoline retail establishment." A facility that dispenses |
10 | gasoline directly to members of the public for use in vehicles |
11 | that operate on the highways of this Commonwealth. |
12 | Section 2. This act shall take effect in 60 days. |
