| AN ACT |
| |
1 | Providing for lead-level testing of playgrounds, schools and |
2 | parks. |
3 | The General Assembly of the Commonwealth of Pennsylvania |
4 | hereby enacts as follows: |
5 | Section 1. Short title. |
6 | This act shall be known and may be cited as the Lead-Level |
7 | Testing Act. |
8 | Section 2. Definitions. |
9 | The following words and phrases when used in this act shall |
10 | have the meanings given to them in this section unless the |
11 | context clearly indicates otherwise: |
12 | "Department." The Department of Health of the Commonwealth. |
13 | "Risk area." Any of the following: |
14 | (1) A playground. |
15 | (2) A public, private or parochial elementary or |
16 | secondary school. |
17 | (3) A public park. |

1 | Section 3. Testing and reporting. |
2 | (a) Testing.--The department shall test the paint in risk |
3 | areas to determine the presence and levels of lead in paint. The |
4 | department shall schedule testing so that all risk areas in this |
5 | Commonwealth are tested within five years. |
6 | (b) Report.--The department shall publish in the |
7 | Pennsylvania Bulletin an annual report of the testing under |
8 | subsection (a). |
9 | Section 4. Effective date. |
10 | This act shall take effect in 60 days. |
