| AN ACT |
| |
1 | Amending Title 53 (Municipalities Generally) of the Pennsylvania |
2 | Consolidated Statutes, in neighborhood blight reclamation and |
3 | revitalization, providing for divestiture of tax claims and |
4 | municipal liens upon agreement of governing bodies. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Section 6141 of Title 53 of the Pennsylvania |
8 | Consolidated Statutes is amended to read: |
9 | § 6141. [(Reserved).] Divestiture of tax claims and municipal |
10 | liens upon agreement of majority of governing bodies. |
11 | (a) General rule.--A majority of the governing bodies of a |
12 | county, municipality and school district that levy real property |
13 | taxes on a property regarded as a public nuisance and targeted |
14 | for demolition may petition the court of common pleas for the |
15 | county in which the property is situated to divest all county, |
16 | municipal and school district tax claims and municipal liens |
17 | against the property if the governing body of each county, |
18 | municipality or school district represented in the majority have |

1 | adopted a resolution indicating that governing body's approval |
2 | of the divestiture of its tax claims and municipal liens against |
3 | the property and of the filing of the petition. |
4 | (b) Attorney fees and court costs.--If not all of the |
5 | governing bodies of the county, municipality and school district |
6 | that levy real property taxes on the property have adopted a |
7 | resolution authorized under subsection (a), then the court shall |
8 | award attorney fees and court costs to the governing bodies that |
9 | represent the majority of the governing bodies which filed the |
10 | petition. |
11 | Section 2. This act shall take effect in 60 days. |
