| AN ACT |
| |
1 | Amending Title 75 (Vehicles) of the Pennsylvania Consolidated |
2 | Statutes, further providing for definitions, for traffic- |
3 | control signals, for pedestrian-control signals and for |
4 | right-of-way of pedestrians in crosswalks. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Section 102 of Title 75 of the Pennsylvania |
8 | Consolidated Statutes is amended by adding a definition to read: |
9 | § 102. Definitions. |
10 | Subject to additional definitions contained in subsequent |
11 | provisions of this title which are applicable to specific |
12 | provisions of this title, the following words and phrases when |
13 | used in this title shall have, unless the context clearly |
14 | indicates otherwise, the meanings given to them in this section: |

16 | "Half of the roadway." All traffic lanes conveying traffic |
17 | in one direction of travel and the entire width of a one-way |

3 | Section 2. Section 3112(a) is amended by adding a paragraph |
4 | and the section is amended by adding a subsection to read: |
5 | § 3112. Traffic-control signals. |
6 | (a) General rule.--Whenever traffic is controlled by |
7 | traffic-control signals exhibiting different colored lights, or |
8 | colored lighted arrows, successively one at a time or in |
9 | combination, only the colors green, red and yellow shall be |
10 | used, except for special pedestrian signals carrying a word |
11 | legend, and the lights shall indicate and apply to drivers of |
12 | vehicles and pedestrians as follows: |

14 | (4) Pedestrians lawfully within intersection or adjacent |
15 | crosswalk.--The driver of a vehicle required to yield the |
16 | right-of-way to pedestrians lawfully within the intersection |
17 | or an adjacent crosswalk shall stop and remain stopped for a |
18 | pedestrian crossing a roadway at a crosswalk when the |
19 | pedestrian is upon, or within one lane of, the half of the |
20 | roadway upon which the vehicle is traveling or onto which it |
21 | is turning. |

23 | (d) Penalties.--A driver of a vehicle who violates this |
24 | section commits a summary offense and shall, upon conviction, be |
25 | sentenced to pay: |
26 | (1) Except as set forth under paragraph (2), a fine of |
27 | $50. |
28 | (2) For a violation of subsection (a), a fine of not |
29 | less than $200 if the violation occurred in a school zone as |
30 | defined and established under regulations of the department. |

1 | Section 3. Section 3113(c) of Title 75 is amended and the |
2 | section is amended by adding a subsection to read: |
3 | § 3113. Pedestrian-control signals. |

5 | (a.1) Duty of driver.--The driver of a vehicle required to |
6 | yield the right-of-way to a pedestrian under subsection (a)(1), |
7 | (3) or (4) shall stop and remain stopped to allow a pedestrian |
8 | to cross the roadway within a crosswalk when the pedestrian is |
9 | upon, or within one lane of, the half of the roadway upon which |
10 | the vehicle is traveling or onto which it is turning. |

12 | (c) Penalties.--[The driver of a vehicle who violates |
13 | subsection (a) commits a summary offense and, upon conviction, |
14 | shall be sentenced to pay a fine of $50. This subsection] A |
15 | driver of a vehicle who violates this section commits a summary |
16 | offense and shall, upon conviction, be sentenced to pay: |
17 | (1) Except as set forth under paragraph (2), a fine of |
18 | $50. |
19 | (2) For a violation of subsection (a), a fine of not |
20 | less than $200 if the violation occurred in a school zone as |
21 | defined and established under regulations of the department. |
22 | (d) Applicability.--Subsection (c) shall not apply to those |
23 | municipalities that establish a summary offense as authorized |
24 | under subsection (b) with a fine in excess of $50. |
25 | Section 4. Section 3542(a) and (e) of Title 75 are amended |
26 | to read: |
27 | § 3542. Right-of-way of pedestrians in crosswalks. |
28 | (a) General rule.--When traffic-control signals are not in |
29 | place or not in operation, the driver of a vehicle shall yield |
30 | the right-of-way to a pedestrian crossing the roadway within any |

1 | marked crosswalk or within any unmarked crosswalk at an |
2 | intersection. The driver of a vehicle shall stop and remain |
3 | stopped to allow a pedestrian to cross the roadway within a |
4 | marked crosswalk or within an unmarked crosswalk at an |
5 | intersection when the pedestrian is upon, or within one lane of, |
6 | the half of the roadway upon which the vehicle is traveling or |
7 | onto which it is turning. |

9 | (e) Penalties.--[The driver of a vehicle who violates |
10 | subsection (a) commits a summary offense and shall, upon |
11 | conviction, be sentenced to pay a fine of $50.] A driver of a |
12 | vehicle who violates this section commits a summary offense and |
13 | shall, upon conviction, be sentenced to pay: |
14 | (1) Except as set forth under paragraph (2), a fine of |
15 | $50. |
16 | (2) For a violation of subsection (a), a fine of not |
17 | less than $200 if the violation occurred in a school zone as |
18 | defined and established under regulations of the department. |
19 | Section 5. This act shall take effect in 60 days. |
