| AN ACT |
| |
1 | Amending the act of April 9, 1929 (P.L.177, No.175), entitled |
2 | "An act providing for and reorganizing the conduct of the |
3 | executive and administrative work of the Commonwealth by the |
4 | Executive Department thereof and the administrative |
5 | departments, boards, commissions, and officers thereof, |
6 | including the boards of trustees of State Normal Schools, or |
7 | Teachers Colleges; abolishing, creating, reorganizing or |
8 | authorizing the reorganization of certain administrative |
9 | departments, boards, and commissions; defining the powers and |
10 | duties of the Governor and other executive and administrative |
11 | officers, and of the several administrative departments, |
12 | boards, commissions, and officers; fixing the salaries of the |
13 | Governor, Lieutenant Governor, and certain other executive |
14 | and administrative officers; providing for the appointment of |
15 | certain administrative officers, and of all deputies and |
16 | other assistants and employes in certain departments, boards, |
17 | and commissions; and prescribing the manner in which the |
18 | number and compensation of the deputies and all other |
19 | assistants and employes of certain departments, boards and |
20 | commissions shall be determined," establishing the Emergency |
21 | State Employee Salary Fund. |
22 | The General Assembly of the Commonwealth of Pennsylvania |
23 | hereby enacts as follows: |
24 | Section 1. The act of April 9, 1929 (P.L.177, No.175), known |
25 | as The Administrative Code of 1929, is amended by adding a |
26 | section to read: |

1 | Section 225. Emergency State Employee Salary Fund.--(a) The |
2 | Emergency State Employee Salary Fund is established as a |
3 | separate fund in the State Treasury. The moneys of the fund are |
4 | hereby appropriated on a continuing basis to carry out the |
5 | provisions of this section. |
6 | (b) If a general appropriation act is not enacted by June |
7 | 30, the State Treasurer shall periodically transfer |
8 | unappropriated, unrestricted General Fund moneys, to the extent |
9 | that such funds are available, to the Emergency State Employee |
10 | Salary Fund. The transfers shall be up to such dollar amounts |
11 | and at such times as necessary to meet the requirements of |
12 | section 223. |
13 | (c) If the Governor fails to certify revenue estimates under |
14 | section 618 for the current fiscal year the Secretary of Revenue |
15 | shall certify to the State Treasurer each time a transfer is |
16 | needed under subsection (a) that there are adequate |
17 | unappropriated, unrestricted General Fund moneys to make the |
18 | transfer. |
19 | (d) The Secretary of Administration shall draw a warrant on |
20 | the State Treasurer in favor of each State agency for the amount |
21 | to which it is entitled, to pay the salaries of its employees as |
22 | required under section 223. |
23 | (e) Transfers provided under this section shall only be in |
24 | effect during the time in which no general appropriation act has |
25 | been enacted and shall be made only in the amount necessary to |
26 | pay the salaries of State employees as required under section |
27 | 223. |
28 | Section 2. This act shall take effect immediately. |
