| AN ACT |
| |
1 | Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An |
2 | act relating to the public school system, including certain |
3 | provisions applicable as well to private and parochial |
4 | schools; amending, revising, consolidating and changing the |
5 | laws relating thereto," in State System of Higher Education, |
6 | further providing for chancellor and for powers and duties of |
7 | the Board of Governors. |
8 | The General Assembly of the Commonwealth of Pennsylvania |
9 | hereby enacts as follows: |
10 | Section 1. Section 2005-A(11) of the act of March 10, 1949 |
11 | (P.L.30, No.14), known as the Public School Code of 1949, added |
12 | November 12, 1982 (P.L.660, No.188), is amended to read: |
13 | Section 2005-A. The Chancellor.--The chief executive officer |
14 | of the system shall be a chancellor, who shall be employed by |
15 | the board in accordance with clause (1) of section 2006-A. In |
16 | addition to those prescribed by the board, the chancellor shall |
17 | have the following duties: |

19 | (11) The chancellor shall negotiate or cause to be |
20 | negotiated on behalf of the board and subject to its final |

1 | approval collective bargaining agreements pursuant to the act of |
2 | July 23, 1970 (P.L.563, No.195), known as the "Public Employe |
3 | Relations Act," in accordance with section 2003-A of this act. |
4 | In such collective bargaining agreements, the chancellor may not |
5 | negotiate or cause to be negotiated any provision that expressly |
6 | limits or has the effect of limiting the number of faculty |
7 | members who teach at least fifteen (15) credit hours per |
8 | semester or who are otherwise deemed to be full-time professors. |

10 | Section 2. Section 2006-A(a)(8) of the act, amended July 11, |
11 | 1990 (P.L.424, No.103), is amended to read: |
12 | Section 2006-A. Powers and Duties of the Board of |
13 | Governors.--(a) The Board of Governors shall have overall |
14 | responsibility for planning and coordinating the development and |
15 | operation of the system. The powers and duties of the Board of |
16 | Governors shall be: |

18 | (8) To establish general personnel policies under which the |
19 | institutions shall operate consistent with merit principles; to |
20 | determine equivalent degree and teaching experience |
21 | qualifications for appointment or promotion of faculty employes |
22 | within the classifications enumerated in the act of January 18, |
23 | 1952 (1951 P.L.2111, No.600), referred to as the State College |
24 | Faculty Compensation Law, to include, but not be limited to, the |
25 | Degrees of Juris Doctor and Master of Fine Arts; and to enter |
26 | into collective bargaining agreements pursuant to the act of |
27 | July 23, 1970 (P.L.563, No.195), known as the "Public Employe |
28 | Relations Act," in accordance with section 2003-A of this act. |
29 | In entering into such collective bargaining agreements, the |
30 | Board of Governors may not approve any provision that expressly |

3 | semester or who are otherwise deemed to be full-time professors. |

5 | Section 3. This act shall apply to collective bargaining |
6 | agreements entered into after the effective date of this |
7 | section. |
8 | Section 4. This act shall take effect in 60 days. |
