AN ACT

Imposing a moratorium on the establishment of new or expanded

2

methadone clinics and requiring the Legislative Budget and

3

Finance Committee to conduct a study to determine the impact

4

of these clinics on the communities in which they are

5

located.

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

8

Section 1.  Short title.

9

This act shall be known and may be cited as the Methadone

10

Clinic Moratorium Act.

11

Section 2.  Definitions.

12

The following words and phrases when used in this act shall

13

have the meanings given to them in this section unless the

14

context clearly indicates otherwise:

15

"Committee."  The Legislative Budget and Finance Committee.

16

"Department."  The Department Health of the Commonwealth.

17

Section 3.  Methadone clinic moratorium.

(a)  Declaration.--Notwithstanding any other provision of law

to the contrary, a moratorium is established during which the

2

department shall not approve applications for licenses of any

3

new methadone clinics or the expansion of methadone clinics

4

currently in existence. The moratorium shall extend from the

5

effective date of this section to the earlier of:

6

(1)  One hundred eighty days after publication of the

7

notice under section 4(b)(2); or

8

(2)  May 30, 2011.

(b)  Construction.--Nothing in this act shall be construed as

10

to prohibit patients from obtaining treatment at an existing

11

methadone clinic licensed by the department.

Section 4.  Committee.

13

(a)  Study.--The committee shall study methadone clinics in

14

this Commonwealth and their impact on the communities in which

15

they are located. In conducting this study, the committee shall

16

inquire into the following:

17

(1)  The number and location, by municipality of each

18

methadone clinic.

19

(2)  The number of patients served by each clinic.

20

(3)  The type of community in which each clinic is

21

located.

22

(4)  The impact on the area surrounding the clinic with

23

regard to traffic, local economy and crime statistics.

24

(5)  Initiatives other states have pursued to address

25

problems which may have arisen with the establishment of

26

methadone clinics.

27

(b)  Report.--By November 30, 2010, the committee shall:

28

(1)  submit a report on its study, including

29

recommendations, to the General Assembly; and

30

(2)  transmit a copy of the report to the Legislative

Section 10.  Effective date.

This act shall take effect in 60 days.
