AN ACT

Amending the act of May 28, 1937 (P.L.955, No.265), entitled, as

2

amended, "An act to promote public health, safety, morals,

3

and welfare by declaring the necessity of creating public

4

bodies, corporate and politic, to be known as housing

5

authorities to engage in slum clearance, and to undertake

6

projects, to provide dwelling accommodations for persons of

7

low income; providing for the organization of such housing

8

authorities; defining their powers and duties; providing for

9

the exercise of such powers, including the acquisition of

10

property by purchase, gift or eminent domain, the renting and

11

selling of property, and including borrowing money, issuing

12

bonds, and other obligations, and giving security therefor;

13

prescribing the remedies of obligees of housing authorities;

14

authorizing housing authorities to enter into agreements,

15

including agreements with the United States, the

16

Commonwealth, and political subdivisions and municipalities

17

thereof; defining the application of zoning, sanitary, and

18

building laws and regulations to projects built or maintained

19

by such housing authorities; exempting the property and

20

securities of such housing authorities from taxation; and

21

imposing duties and conferring powers upon the State Planning

22

Board, and certain other State officers and departments,"

23

further providing for powers of an authority; and providing

24

for contracts to promote participation.

The General Assembly of the Commonwealth of Pennsylvania

26

hereby enacts as follows:

27

Section 1.  Section 10 of the act of May 28, 1937 (P.L.955,

28

No.265), known as the Housing Authorities Law, is amended by

29

adding a clause to read:

Section 10.  Powers of an Authority.--An Authority shall

2

constitute a public body, corporate and politic, exercising

3

public powers of the Commonwealth as an agency thereof, which

4

powers shall include all powers necessary or appropriate to

5

carry out and effectuate the purpose and provisions of this act,

6

including the following powers, in addition to others herein

7

granted:

(e.1)  To develop, adopt and implement binding policies or

10

guidelines to ensure that all persons are accorded equal

11

opportunity in employment and contracting associated with

12

housing projects. This clause shall apply to an Authority's

13

contractors, subcontractors, assignees, lessees, agents, vendors

14

and suppliers.

Section 2.  The act is amended by adding a section to read:

17

Section 11.2.  Contracts to Promote Participation.--(a)  An

18

Authority shall develop, adopt, and implement binding policies

19

or guidelines to ensure that all persons are accorded equal

20

opportunity in contracting and subcontracting associated with

21

any construction, erection, installation, completion,

22

alteration, repair of or addition to any project or other work

23

subject to the control of any Authority in accordance with

24

section 11.

(b)  Every contract for or on behalf of an Authority for the

26

construction, erection, installation, completion, alteration,

27

repair of or addition to any project or other work subject to

28

the control of any Authority shall contain provisions by which

29

the contractor agrees to promote, increase and sustain

30

contracting and subcontracting opportunities for disadvantaged

businesses.

(c)  This section shall apply to:

3

(1)  Any contract for or on behalf of an Authority which is

4

subject to advertisement and competitive bidding.

5

(2)  Any written or telephonic price quotation which requires

6

advertisement and competitive bidding in accordance with the

7

requirements of this act. Records of written price quotations,

8

telephonic price quotations and memoranda shall be retained for

9

a period of three years.

(3)  All Authority contractors, subcontractors, assignees,

11

lessees, agents, vendors and suppliers.

12

(4)  Any disadvantaged business.

13

(d)  The Authority may use the lists of certified minority-

14

owned, women-owned and veteran-owned business enterprises which

15

have been certified under the Department of General Services'

16

disadvantaged business program to compete for and participate in

17

the Authority's contracting process. The Department of General

18

Services shall cooperate with and assist an Authority in

19

carrying out the requirements of this subsection.

20

(e)  For the purpose of this section, the following words and

21

phrases shall have the meaning given to them in this subsection

22

unless the context clearly indicates otherwise:

23

"Disadvantaged business."  A small business which is owned or

24

controlled by a majority of persons, not limited to members of

25

minority groups, who:

26

(1)  have been deprived of the opportunity to develop and

27

maintain a competitive position in the economy because of social

28

disadvantages; or

29

(2)  are veterans, including service-disabled veterans.

30

"Service-disabled veteran."  A veteran who possesses either

an adjudication letter from the Department of Veterans Affairs

2

establishing a service-connected disability rating or a

3

disability determination from the Department of Defense.

4

"Small business."  The term shall have the meaning given to

5

it in 62 Pa.C.S. § 2102 (relating to definitions).

6

"Veteran."  An individual who:

7

(1)  served in the active United States military in any of

8

the four current branches and all previous branches, including a

9

reserve component or the National Guard;

10

(2)  was released or discharged from active military service

11

under conditions other than dishonorable; and

12

(3)  possesses a certificate of release or discharge from

13

active duty.

Section 3.  This act shall take effect in 60 days.
