| AN ACT |
| |
1 | Amending the act of February 9, 1999 (P.L.1, No.1), entitled "An |
2 | act providing for borrowing for capital facilities; |
3 | conferring powers and duties on various administrative |
4 | agencies and officers; making appropriations; and making |
5 | repeals," further providing for reports related to |
6 | redevelopment assistance capital projects and for funding and |
7 | administration of redevelopment assistance capital projects. |
8 | The General Assembly of the Commonwealth of Pennsylvania |
9 | hereby enacts as follows: |
10 | Section 1. Section 313.1 of the act of February 9, 1999 |
11 | (P.L.1, No.1), known as the Capital Facilities Debt Enabling |
12 | Act, added December 22, 2005 (P.L.454, No.87), is amended to |
13 | read: |
14 | Section 313.1. Reports related to redevelopment assistance |
15 | capital projects. |
16 | (a) Quarterly report.--The Secretary of the Budget shall, |
17 | within ten days of the expiration of each quarter of each fiscal |
18 | year, provide to the Governor, Auditor General, chairman and |

1 | minority chairman of the Appropriations Committee of the Senate |
2 | and the chairman and minority chairman of the Appropriations |
3 | Committee of the House of Representatives a report relating to |
4 | redevelopment assistance capital projects which addresses at |
5 | least all of the following materials: |
6 | (1) An itemized list of the redevelopment assistance |
7 | capital projects approved for release and construction in the |
8 | preceding quarter. |
9 | (2) An estimate of the amount of funds remaining under |
10 | the cap provided in section 317(b). |
11 | (3) An estimate of the total amount of outstanding debt |
12 | related to redevelopment assistance capital projects. |
13 | (4) An estimate of the amount of outstanding debt |
14 | related to redevelopment assistance capital projects which |
15 | will be paid or refinanced in the succeeding four quarters. |
16 | (b) Five-year report.--The Secretary of the Budget shall, |
17 | every five years, or at the request of the Governor or Auditor |
18 | General, provide to the Governor, Auditor General, chairman and |
19 | minority chairman of the Appropriations Committee of the Senate |
20 | and the chairman and minority chairman of the Appropriations |
21 | Committee of the House of Representatives a report relating to |
22 | redevelopment assistance capital projects which addresses at |
23 | least all of the following materials: |
24 | (1) An itemized list of the redevelopment assistance |
25 | capital projects approved for release and construction in the |
26 | preceding five years. |
27 | (2) An estimate of the amount of funds remaining under |
28 | the cap provided in section 317(b). |
29 | (3) An estimate of the total amount of outstanding debt |
30 | related to redevelopment assistance capital projects. |

4 | (c) Internet access to reports.--The Secretary of the Budget |
5 | shall make all information provided under subsections (a) and |
6 | (b) and all contracts for redevelopment assistance capital |
7 | projects that constitute a public record as defined in section |
8 | 102 of the act of February 14, 2008 (P.L.6, No.3), known as the |
9 | Right-to-Know Law, available on the Office of the Budget's |
10 | publicly accessible Internet website. |
11 | Section 2. Section 318 of the act is amended by adding |
12 | subsections to read: |
13 | Section 318. Funding and administration of redevelopment |
14 | assistance capital projects. |
15 | * * * |
16 | (j) Notification.--No fewer than 45 days prior to execution |
17 | of a contract: |
18 | (1) The Secretary of the Budget shall notify, in |
19 | writing, the State senator and State representative in whose |
20 | districts the redevelopment assistance capital project is |
21 | located. |
22 | (2) At least one public informational meeting regarding |
23 | the redevelopment assistance capital project shall be held |
24 | within a ten-mile radius of the redevelopment assistance |
25 | capital project site. If no suitable venue is available |
26 | within a ten-mile radius of the redevelopment assistance |
27 | capital project site, the Secretary of the Budget, in |
28 | consultation with the applicant, the State senator and the |
29 | State representative may expand the radius by a reasonable |
30 | distance. Any expenses for the public informational meeting |

1 | shall be paid by the applicant. Notice of the public |
2 | informational meeting shall be published in the Pennsylvania |
3 | Bulletin. |
4 | (k) Waiting period.--No redevelopment assistance capital |
5 | project contracts may be executed in the period between the date |
6 | of any general election at which a Governor is elected and the |
7 | third Tuesday of January next ensuing the election. |
8 | Section 3. This act shall take effect in 60 days. |
