Amending Title 74 (Transportation) of the Pennsylvania

Consolidated Statutes, providing for gateway tolls,

definitions, powers and duties of the department, toll

4

revenue distribution and discounted tolls.

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

7

Section 1.  Title 74 of the Pennsylvania Consolidated

8

Statutes is amended by adding a chapter to read:

§ 8501.  Short title of chapter.

This chapter shall be known and may be cited as the Gateway

3

Tolling for Transportation Independence Today Act.

4

§ 8502.  Scope of chapter.

5

This chapter relates to the creation and regulation of all

6

toll roads in this Commonwealth other than the Pennsylvania

7

Turnpike.

§ 8503.  Definitions.

9

The following words and phrases when used in this chapter

10

shall have the meanings given to them in this section unless the

11

context clearly indicates otherwise:

12

"Department."  The Department of Transportation of the

13

Commonwealth.

14

"Interstate highway."  Any Commonwealth road designated by

15

the Department of Transportation as an interstate. This term

16

shall not include the Pennsylvania Turnpike.

§ 8511.  Establishment.

There is established on all interstate highways a gateway

26

toll. This toll shall be collected at the entrance to

27

Pennsylvania and at the exit from Pennsylvania of all interstate

28

highways.

§ 8512. Powers and duties of the department.

30

(a)  Collection of tolls.--The department shall have the

authority to collect tolls at the entrance to Pennsylvania and

2

at the exit from Pennsylvania for all interstate highways.

(b)  Amount of tolls.--The toll shall be $5 per commercial

4

motor vehicle and $1 per noncommercial motor vehicle. The

5

department shall review the tolls on an annual basis and have

6

the authority to alter the tolls no earlier than two years after

7

the passage of this act.

8

(c)  Method of collecting tolls.--The department shall devise

9

a method of collecting tolls that is accurate, allows for the

10

collection of tolls with cash and allows for the collection of

11

tolls electronically.

12

(d)  Federal approval.--The department shall be responsible

13

for submitting all necessary information to the Federal

14

Department of Transportation and the Federal Highway

15

Administration. The department shall also be responsible for

16

responding to requests from the Federal Department of

17

Transportation and the Federal Highway Administration regarding

18

the tolls collected under this subchapter.

19

(e)  Rules and regulations.--Within 30 days of the effective

20

date of this chapter, the department shall promulgate rules,

21

regulations and amounts of the tolls and fees, including

22

estimated implementation budget, which will be funded from these

23

tolls. The department shall submit this information to the

24

Pennsylvania Code for publication. The department shall hold a

25

public hearing on the proposed toll rates within 30 days of

26

publication.

§ 8513.  Toll revenue distribution.

28

(a)  Use.--Revenue collected by the department shall be used

29

as follows:

(1)  To pay for the maintenance, upkeep and improvements

to the interstate highways.

(2)  For the costs of the department for administering

3

the toll program under this chapter.

4

(3)  For mass transit funding.

5

(b)  Guidelines.--The department may use the protocols set

6

forth under Chapter 15 (relating to sustainable mobility

7

options) as a guideline for distribution.

§ 8514. Discounted tolls.

9

(a)  Implementation.--The department shall implement a

10

program allowing for discounted tolls when an individual or

11

entity prepurchases tolls in bulk. This discount shall be at

12

least 25% but not more than 50% less than the current full cost

13

for the tolls being prepurchased. The prepurchased tolls shall

14

be valid for at least the first five years at which time the

15

department may adjust this rate to by no less than 10% and no

16

more than 20%.

(b)  Usage.--All prepurchased tolls shall be utilized with

18

the electronic payment system that the department shall

19

implement under section 8512(c) (relating to powers and duties

20

of the department).

Section 2. This act shall take effect in 60 days.
