AN ACT

Amending Title 35 (Health and Safety) of the Pennsylvania

2

Consolidated Statutes, further providing for community

3

disaster loans and for individual and family assistance.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 7304 of Title 35 of the Pennsylvania

7

Consolidated Statutes is amended by adding a paragraph to read:

8

§ 7304.  Community disaster loans.

9

Whenever, at the request of the Governor, the President has

10

declared a major disaster to exist in this Commonwealth, the

11

Governor is authorized:

(4)  (i)  Communities approved to receive assistance

14

under the Robert T. Stafford Disaster Relief and

15

Emergency Assistance Act (Public Law 93-288, 42 U.S.C. §

16

5121 et seq.) from the Federal Government shall be

eligible to receive immediate distribution of the Federal

2

amount authorized in the form of a loan from the

3

Commonwealth. The loans shall be offered interest free

4

for the first 60 days of the loan and at a 1% annual rate

5

of interest thereafter. The loan program shall be

6

administered by the Pennsylvania Emergency Management

7

Agency.

8

(ii)  The budget surplus revenue is appropriated from

9

the General Fund to the Flood Damage Minimization Fund

10

for the purposes of funding the loan program under

11

subparagraph (i).

Section 2.  Section 7305 of Title 35 is amended by adding a

13

subsection to read:

§ 7305.  Individual and family assistance.

15

(d)  Distribution.--

17

(1)  Individuals approved to receive assistance under The

18

Robert T. Stafford Disaster Relief and Emergency Assistance

19

Act from the Federal Government shall be eligible to receive

20

immediate distribution of the Federal amount authorized in

21

the form of a loan from the Commonwealth. The loans shall be

22

offered interest free for the first 60 days of the loan and

23

at a 1% annual rate of interest thereafter. The loan program

24

shall be administered by the Pennsylvania Emergency

25

Management Agency.

(2)  The budget surplus revenue is appropriated from the

27

General Fund to the Flood Damage Minimization Fund for the

28

purposes of funding the loan program under paragraph (1).

29

Section 3.  This act shall take effect immediately.
