AN ACT

Amending Title 18 (Crimes and Offenses) of the Pennsylvania

2

Consolidated Statutes, further providing for concealing death

3

of child.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 4303(a) of Title 18 of the Pennsylvania

7

Consolidated Statutes is amended and the section is amended by

8

adding a subsection to read:

9

§ 4303.  Concealing death of child.

10

(a)  Offense defined.--A person is guilty of a [misdemeanor

11

of the first degree] felony of the third degree if he or she as

12

a parent, individual residing in the same household as the child

or an individual responsible for the child's welfare, endeavors

14

privately, either alone or by the procurement of others, to

conceal the death of [his or her] the child, so that it may not

<--

2

come to light, whether it was born dead or alive or whether it

3

was murdered or not.

(c)  Definitions.--As used in this section, the following

6

words and phrases shall have the meanings given to them in this

7

subsection unless the context clearly indicates otherwise:

8

"Parent."  A natural parent, stepparent, adoptive parent,

9

guardian , a person responsible for the child's welfare, any

individual residing in the same home as the child or a paramour

11

of the child's parent guardian or an individual involved in an

<--

12

intimate relationship with the child's parent.

13

Section 2.  This act shall take effect in 60 days.
