AN ACT

Amending Title 65 (Public Officers) of the Pennsylvania

2

Consolidated Statutes, in ethics standards and financial

3

disclosure, further providing for statement of financial

4

interests required to be filed.

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

7

Section 1.  Section 1104(b) of Title 65 of the Pennsylvania

8

Consolidated Statutes is amended to read:

9

§ 1104.  Statement of financial interests required to be filed.

(b)  Candidate.--

12

(1)  Any candidate for a State-level public office shall

13

file a statement of financial interests for the preceding

14

calendar year with the commission on or before the last day

15

for filing a [petition] nomination certificate, petition,

16

papers or substituted nomination certificate to appear on the

ballot for election. A copy of the statement of financial

2

interests shall also be appended to such [petition]

3

nomination certificate, petition, papers or substituted

4

nomination certificate.

(2)  Any candidate for county-level or local office shall

6

file a statement of financial interests for the preceding

7

calendar year with the governing authority of the political

8

subdivision in which he is a candidate on or before the last

9

day for filing a [petition] nomination certificate, petition,

10

papers or substituted nomination certificate to appear on the

11

ballot for election. A copy of the statement of financial

12

interests shall also be appended to such [petition]

13

nomination certificate, petition, papers or substituted

14

nomination certificate.

(3)  No [petition] nomination certificate, petition,

16

papers or substituted nomination certificate to appear on the

17

ballot for election shall be accepted by the respective State

18

or local election officials unless the petition has appended

19

thereto a statement of financial interests as set forth in

20

paragraphs (1) and (2). Failure to file the statement in

21

accordance with the provisions of this chapter shall, in

22

addition to any other penalties provided, be a fatal defect

23

to a petition to appear on the ballot. However, if an

24

objection petition is filed under section 632, 977, 982, 996

<--

25

or 999 of the act of June 3, 1937 (P.L.1333, No.320), known

26

as the Pennsylvania Election Code, to any nomination

27

certificate, petition, papers or substituted nomination

28

certificate based on nonfraudulent errors or omissions in the

29

content of a statement of financial interests appended to a

30

nomination certificate, petition, papers or substituted

nomination certificate as required under this section, the

2

court may permit amendment of the statement of financial

3

interests to correct such nonfraudulent errors or omissions

4

in the content of the statement of financial interests so

5

long as the statement of financial interests was filed with

6

the commission or the governing authority of the political

7

subdivision, as required under law.

Section 2.  This act shall take effect in 60 days.
