AN ACT

Amending Title 51 (Military Affairs) of the Pennsylvania

2

Consolidated Statutes, providing for tuition refund under

3

certain circumstances.

4

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Title 51 of the Pennsylvania Consolidated

7

Statutes is amended by adding a chapter to read:

8

The following words and phrases when used in this chapter

shall have the meanings given to them in this section unless the

2

context clearly indicates otherwise:

3

"Institution of higher learning."  Any educational

4

institution located in this Commonwealth that is authorized to

5

grant degrees or certificates for a postsecondary course of

6

study.

7

"Student."  A Commonwealth resident enrolled in an

8

institution of higher learning on a full-time or part-time

9

basis.

§ 8802.  Refund of tuition and fees.

11

(a)  General rule.--When a student of an institution of

12

higher learning is ordered to active Federal or State service as

13

a member of the Pennsylvania National Guard or a reserve

14

component of the armed forces of the United States and is unable

15

to complete a course, the student shall be entitled to a full

16

refund of tuition and fees attributable to that course.

(b)  Prohibitions.--In addition to subsection (a), if a

18

student withdraws from a course because the student is ordered

19

to active service, the institution of higher learning may not:

20

(1)  Give the student a failing grade.

21

(2)  Give the student a grade of incomplete.

22

(3)  Alter the student's grade point average due to the

23

student's withdrawal from the course.

24

(4)  Make any other negative annotation on the student's

25

record.

(c)  Other charges.--Other than tuition and fees under

27

subsection (a), a student who has paid amounts for room, board

28

or other fees shall receive a refund of that portion

29

attributable to the time period during which the student did not

30

use the services because of being ordered to active service.

(d)  Documentation.--The institution of higher learning may

2

require documentation of the student's order to active service.

3

(e)  Financial aid or scholarship award.--A student shall not

4

be entitled to a refund of any financial aid or scholarship

5

award.

6

Section 2.  This act shall take effect in 60 days.
