8 | hereby enacts as follows: |
9 | Section 1. Short title. |
10 | This act shall be known and may be cited as the Citizens |
11 | Constitutional Convention on Property Taxes Act. |
12 | Section 2. Definitions. |
13 | The following words and phrases when used in this act shall |
14 | have the meanings given to them in this section unless the |
15 | context clearly indicates otherwise: |
16 | "Candidate." An individual seeking to become an elected |
17 | delegate. |
18 | "Committee." The preparatory committee established under |
19 | this act. |
20 | "Convention." The citizens constitutional convention |
21 | authorized by this act. |
22 | "County board." A county board of elections. |
23 | "Delegate." An elected or alternate delegate to the |
24 | convention. |
25 | "Elected delegate." A delegate who is elected to the |
26 | convention under this act. |
27 | "Public official." A person elected by the public, elected |
28 | or appointed by a governmental body or an appointed official in |
29 | the executive, legislative or judicial branch of this |
30 | Commonwealth or any of its political subdivisions. The term |

1 | shall not include members of advisory boards that have no |
2 | authority to do any of the following: |
3 | (1) Expend public funds, other than reimbursement for |
4 | personal expenses. |
5 | (2) Otherwise exercise the power of the Commonwealth or |
6 | any of its subdivisions. |
7 | "Secretary." The Secretary of the Commonwealth. |
8 | Section 3. Referendum. |
9 | (a) Question.--At the municipal election in November 2011, |
10 | the following question shall be submitted to the electorate of |
11 | this Commonwealth to determine its will regarding a |
12 | constitutional convention: |
13 | Shall a constitutional convention be called in accordance |
14 | with and subject to the limitations and requirements |
15 | contained in the Citizens Constitutional Convention on |
16 | Property Taxes Act to prepare for submission to the |
17 | electorate proposals for the revision of Article VIII of the |
18 | Constitution of Pennsylvania, which deals with taxation and |
19 | finance, for the purposes of reducing or eliminating property |
20 | taxes? |
21 | (b) Election.--The secretary shall certify questions to the |
22 | county boards. The election shall be conducted in accordance |
23 | with the act of June 3, 1937 (P.L.1333, No.320), known as the |
24 | Pennsylvania Election Code. |
25 | (c) Secretary.--If a majority of the electors casting votes |
26 | on the question under subsection (a) vote in the affirmative, |
27 | the secretary shall transmit notice of the vote to the |
28 | Legislative Reference Bureau for publication as a notice in the |
29 | Pennsylvania Bulletin. |
30 | Section 4. Convention, membership, qualifications and |
|
1 | vacancies. |
2 | (a) Call.--If a majority of the electors voting upon the |
3 | question set forth in section 3(a) votes in the affirmative, a |
4 | convention shall be called by the Governor. |
5 | (b) Delegates.--The convention shall consist of three |
6 | elected delegates from each senatorial district. Each elector in |
7 | each senatorial district may vote for not more than two |
8 | candidates. The three candidates receiving the highest number of |
9 | votes shall be elected delegates. The candidate receiving the |
10 | fourth-highest number of votes shall be the first alternate |
11 | delegate; the candidate receiving the fifth-highest number of |
12 | votes shall be the second alternate delegate. |
13 | (c) Qualifications.--A delegate must meet the following |
14 | qualifications: |
15 | (1) Be at least 18 years of age prior to November 8, |
16 | 2011. |
17 | (2) Have been a citizen and resident of this |
18 | Commonwealth for at least four years before election. |
19 | (3) Have resided in and been a registered elector of the |
20 | elected delegate's senatorial district for at least one year |
21 | preceding election. |
22 | (4) Reside in the elected delegate's senatorial district |
23 | during the delegate's term of service. |
24 | (5) Not be a public official on the effective date of |
25 | this act nor during the delegate's term of service. |
26 | (6) Not be a registered lobbyist in this Commonwealth as |
27 | defined under 65 Pa.C.S. Ch. 13A (relating to lobbying |
28 | disclosure) on the effective date of this act nor during the |
29 | delegate's term of service. |
30 | (d) Salary.--Elected delegates shall be entitled to a salary |
|
1 | equal to the salary of a member of the General Assembly during |
2 | their term of service, payable monthly. |
3 | (e) Expenses.--Elected delegates shall be entitled to |
4 | reimbursement for the following expenses: |
5 | (1) Actual mileage traveled in a personal vehicle in the |
6 | performance of their duties during their term of service, |
7 | documented, reported and payable monthly at the applicable |
8 | Federal rate, including commuting mileage. |
9 | (2) Actual expenses for other modes of ground |
10 | transportation in the performance of their duties during |
11 | their term of service, documented, reported and payable |
12 | monthly, including commuting expenses. |
13 | (3) Actual expenses for overnight lodging required for |
14 | the convenience of elected delegates traveling more than 50 |
15 | miles from their residence in the performance of their duties |
16 | during their term of service, documented, reported and |
17 | payable monthly. |
18 | (f) Terms of service.--Terms of service for elected |
19 | delegates shall commence on the date of their oath of office. |
20 | Terms shall expire September 30, 2012, except for delegate |
21 | members of the preparatory committee, whose terms shall expire |
22 | October 31, 2012. |
23 | (g) Immunity.--The following shall apply: |
24 | (1) A delegate shall, in all cases except treason, |
25 | felony, violation of oath of office and breach of the peace, |
26 | be privileged from arrest during attendance and travel to and |
27 | from the convention. |
28 | (2) A delegate shall not be questioned in any other |
29 | place for any speech or debate in the convention. |
30 | (h) Exclusions.--The following shall apply: |
|
1 | (1) No delegate may, during the delegate's term of |
2 | service, be appointed to or hold any civil office in this |
3 | Commonwealth to which a salary, fee or perquisite is |
4 | attached. |
5 | (2) No member of Congress or other person holding any |
6 | office under the United States or this Commonwealth to which |
7 | a salary, fee or perquisite is attached, except of attorney- |
8 | at-law or in the National Guard or in a reserve component of |
9 | the armed forces of the United States, may be a delegate |
10 | during the person's continuance in office. |
11 | (3) No delegate may serve as a public official for a |
12 | period of two years after the delegate's term of service |
13 | expires. |
14 | Section 5. Nomination of elected delegates and withdrawals. |
15 | (a) Nomination.--Candidates for delegates to the convention |
16 | shall be nominated by petition in accordance with all of the |
17 | following: |
18 | (1) The secretary shall prescribe the form of the |
19 | petition. |
20 | (2) A petition must be signed by at least 100 qualified |
21 | electors of the candidate's senatorial district in accordance |
22 | with all of the following: |
23 | (i) An elector may not sign more than two nomination |
24 | petitions. |
25 | (ii) A signer must state the signer's residence, |
26 | giving city, borough or township, with street and number, |
27 | and that the signer is a qualified elector of the |
28 | district. The signature must be dated. |
29 | (iii) A petition shall not be circulated prior to |
30 | August 23, 2011. A signature shall not be counted unless |
|
1 | it bears a date later than August 22, 2011. |
2 | (iv) A petition may be on one or more sheets. |
3 | Different sheets must be used for signers residing in |
4 | different counties. If more than one sheet is used, the |
5 | sheets must be bound together when offered for filing if |
6 | they are intended to constitute one petition, and each |
7 | sheet must be numbered consecutively at the foot of each |
8 | page, beginning with number one. Each sheet must have |
9 | appended to it the affidavit for the individual who |
10 | circulated it setting forth all of the following: |
11 | (A) That the individual is a qualified elector |
12 | of the senatorial district named in the petition. |
13 | (B) The individual's residence, giving city, |
14 | borough or township, with street and number. |
15 | (C) That the signers to the petition signed with |
16 | the knowledge of the contents of the petition. |
17 | (D) That the residences of the signers are |
18 | correctly stated. |
19 | (E) That each signer resides in the district |
20 | named in the affidavit. |
21 | (F) That each signer signed on the date set |
22 | forth. |
23 | (G) That, to the best of the affiant's knowledge |
24 | and belief, the signers are qualified electors of the |
25 | district. |
26 | (3) A petition must be filed in the office of the |
27 | secretary by 5 p.m. on September 13, 2011. A filing fee of |
28 | $100 must be paid by the candidate by certified check or |
29 | money order. |
30 | (b) Candidate's affidavit.--A candidate must file with the |
|
1 | office of the secretary, by 5 p.m. on September 13, 2011, an |
2 | affidavit stating or attesting to all of the following: |
3 | (1) The candidate's residence with street, number and |
4 | post office address. |
5 | (2) That the candidate is eligible for the office of |
6 | elected delegate to the convention. |
7 | (3) That, if elected, the candidate will faithfully |
8 | observe the limitations and requirements imposed upon the |
9 | convention by this act. |
10 | (4) That the candidate meets the qualifications set |
11 | forth in section 4(c). |
12 | (c) Statement of financial interests.--A candidate must file |
13 | copies of a statement of financial interests with the office of |
14 | the secretary and the State Ethics Commission by 5 p.m. on |
15 | September 13, 2011. |
16 | (d) Withdrawal.--A candidate may withdraw as a candidate if |
17 | the candidate: |
18 | (1) Makes the request in writing. The request must be |
19 | signed by the candidate and acknowledged before an officer |
20 | empowered to administer oaths. |
21 | (2) Files the request in the office of the secretary by |
22 | 5 p.m. on September 20, 2011. |
23 | (e) Certification.--The secretary shall certify the names of |
24 | the nominees to the county boards as provided by law not later |
25 | than September 27, 2011. |
26 | (f) Forms.--The secretary shall provide all forms and |
27 | instructions for candidates in a timely and convenient manner |
28 | consistent with that used for legislative elections. |
29 | Section 6. Elected and alternate delegates. |
30 | Elections for elected delegates shall be held at the |
|
1 | municipal election on November 8, 2011. The secretary shall |
2 | forward to each county board the names of the candidates. |
3 | Candidates' names shall be grouped together on the ballot, |
4 | separate from the names of candidates for any other office, and |
5 | subsequent to the question set forth in section 3(a). Each |
6 | elector voting at the municipal election shall be entitled to |
7 | vote for two candidates from the elector's senatorial district. |
8 | If the question which is set forth in section 3(a) is approved |
9 | by a majority of the electors casting votes: |
10 | (1) The three candidates receiving the highest number of |
11 | votes shall be the elected delegates of that district. |
12 | (2) The candidate receiving the fourth-highest number of |
13 | votes shall be the first alternate delegate; the candidate |
14 | receiving the fifth-highest number of votes shall be the |
15 | second alternate delegate. |
16 | (3) In the case of a tie vote, the election shall be |
17 | determined in accordance with the provisions of section 1418 |
18 | of the act of June 3, 1937 (P.L.1333, No.320), known as the |
19 | Pennsylvania Election Code. |
20 | (4) The county boards shall, by November 22, 2011, |
21 | certify the return of the election for all delegates to the |
22 | secretary. |
23 | (5) The secretary shall, by November 29, 2011, certify |
24 | to the Governor the names of elected and alternate delegates. |
25 | Delegate elections shall be nonpartisan and neither the |
26 | delegate's party affiliation nor any slogan may appear next to a |
27 | candidate's name on the ballot. Bracketing by two or more |
28 | candidates is prohibited. |
29 | Section 7. Vacancies. |
30 | (a) Candidate.--In the event of the death of a candidate |
|
1 | prior to September 27, 2011, that candidate's name shall be |
2 | removed from the ballot. In the event of the death of a |
3 | candidate on or after September 27, 2011, votes received by that |
4 | candidate in the municipal election shall be counted and |
5 | recorded, but void, and a vacancy shall exist. |
6 | (b) Elected delegate.--In the event of a vacancy in the |
7 | office of elected delegate, the first alternate delegate from |
8 | the same senatorial district shall become the elected delegate; |
9 | if the first alternate is unable to serve, the second alternate |
10 | delegate shall become the elected delegate, etc. If no such |
11 | alternate delegate is available to fill a vacancy, the remaining |
12 | elected delegates from the same district, together with the |
13 | Senator from that district, shall collectively nominate a single |
14 | candidate to be confirmed by a majority of the convention as |
15 | soon as practicable to fill the vacancy. |
16 | Section 8. Organization of convention and sessions. |
17 | (a) Convening.--The following shall apply: |
18 | (1) The convention's elected delegates shall convene in |
19 | the Hall of the House of Representatives on December 6, 2011, |
20 | at 12 noon. |
21 | (2) The convention shall be called to order by the |
22 | Governor. |
23 | (3) The secretary shall certify the returns of the |
24 | elections for elected and alternate delegates and issue |
25 | certificates of election. |
26 | (4) The Chief Justice of the Supreme Court shall, after |
27 | the returns have been certified, administer the oath of |
28 | office in the following form: |
29 | I do solemnly swear (or affirm) that I will support, obey and |
30 | defend the Constitution of the United States and the |
|
1 | Constitution of Pennsylvania, that I will abide by the |
2 | limitations and requirements of the Citizens Constitutional |
3 | Convention on Property Taxes Act and that I will discharge my |
4 | duties with fidelity. |
5 | (5) Each elected delegate shall sign and swear a written |
6 | version of the oath of office, provided by the secretary, to |
7 | be preserved with the official journals of the convention, |
8 | and other copies as needed by the secretary. |
9 | (b) Organization.--The following shall apply: |
10 | (1) The convention shall be the final judge of the |
11 | qualifications of its own delegates. |
12 | (2) The convention shall elect from among its elected |
13 | delegates a president, first vice-president, second vice- |
14 | president and a secretary. |
15 | (3) The convention shall elect from among its elected |
16 | delegates 15 members to serve on a preparatory committee with |
17 | the elected officers of the convention. The committee shall |
18 | also include the Majority Leader of the Senate, the Minority |
19 | Leader of the Senate, the Majority Leader of the House of |
20 | Representatives and the Minority Leader of the House of |
21 | Representatives. |
22 | (4) The convention shall organize a committee on |
23 | arrangement, submission and address to the people. |
24 | (c) Duties of preparatory committee.--The following shall |
25 | apply: |
26 | (1) The committee shall prescribe rules for all of the |
27 | following, subject to adoption by a majority of the elected |
28 | delegates at the commencement of working sessions: |
29 | (i) Procedure. |
30 | (ii) Conduct of delegates, including censure, |
|
1 | suspension or removal. |
2 | (2) The committee shall be authorized to do all of the |
3 | following, when required for the conduct of the business of |
4 | the convention: |
5 | (i) Lease or otherwise obtain suitable meeting and |
6 | office space and to purchase or lease supplies, |
7 | equipment, publications and other material necessary for |
8 | the work of the convention. |
9 | (ii) Hire or engage staff necessary for the work of |
10 | the convention. |
11 | (iii) Initiate relevant studies through its own |
12 | personnel or in cooperation with any public or private |
13 | agencies. |
14 | (iv) Hold public hearings. |
15 | (v) Enter into contracts. |
16 | (vi) Receive from the Commonwealth agencies and |
17 | political subdivisions and local agencies assistance |
18 | necessary or desirable to carry out properly the powers |
19 | and duties under this subsection. |
20 | (vii) Submit a budget and additional reports to the |
21 | General Assembly in sufficient time for the General |
22 | Assembly to pass any necessary appropriation act required |
23 | by section 15, as needed. |
24 | (d) Sessions.--The following shall apply: |
25 | (1) The organizational session shall be adjourned not |
26 | later than 5 p.m. on December 8, 2011. |
27 | (2) Working sessions of the convention shall commence on |
28 | January 9, 2012. |
29 | (e) Sine die adjournment.--The convention shall adjourn sine |
30 | die September 11, 2012. |

1 | Section 9. Function. |
2 | (a) Scope.--The convention shall recommend to the electorate |
3 | three varying proposals, each designed to reduce or eliminate |
4 | property taxes under Article VIII of the Constitution of |
5 | Pennsylvania. The proposals may include replacing all or a |
6 | portion of the property tax with another tax. |
7 | (b) Limitations.--The convention shall have the power to |
8 | make recommendations to the electorate on Article VIII relating |
9 | to taxation and finance. The convention may not make |
10 | recommendations on any other articles. |
11 | (c) Reorganization.--In dealing with the subject matter |
12 | under subsections (a) and (b), the convention may recommend |
13 | amendment, addition, deletion, division, substitution, transfer |
14 | and implementation schedules. |
15 | Section 10. Manner of submitting proposals to electorate. |
16 | (a) Convention.--The following shall apply: |
17 | (1) The convention shall submit to the electorate three |
18 | separate proposals to reduce or eliminate property taxes |
19 | along with a fourth proposal to continue without change. |
20 | (2) The convention shall frame the ballot question |
21 | listing each proposal so that each elector may choose only |
22 | one. |
23 | (3) If no proposal receives at least 50% of the total |
24 | votes cast, the Constitution of Pennsylvania shall not be |
25 | amended. |
26 | (b) Certification.--The changes proposed and the ballot |
27 | question shall be certified by the president and secretary of |
28 | the convention to the secretary by September 25, 2012. |
29 | Section 11. Submission to electorate. |
30 | (a) Secretary.--The following shall apply: |
|
1 | (1) The secretary shall publish the Constitution of |
2 | Pennsylvania showing the changes proposed by the convention |
3 | and any address to the people by the convention, in |
4 | convenient printed form and in convenient digital form at the |
5 | earliest time practicable after certification. |
6 | (2) The secretary shall advertise the proposals and |
7 | address of the convention in at least two newspapers of |
8 | general circulation in every county once during the second |
9 | week of October 2012 and once during the fourth week of |
10 | October 2012. |
11 | (3) The secretary shall send a sufficient number of |
12 | copies of the printed publication under paragraph (1) to each |
13 | county board to satisfy the requirements of subsection (b). |
14 | (4) Upon request of an elector, the secretary shall send |
15 | a copy of the publication under paragraph (1). |
16 | (b) County boards.--Each county board shall make the |
17 | publication under subsection (a)(1) available at each polling |
18 | place in a quantity equal to the number of voting booths, |
19 | terminals or stations at that polling place. |
20 | (c) Election.--The following shall apply: |
21 | (1) The three proposals recommended by the convention, |
22 | along with the proposal to continue without change, shall be |
23 | submitted to the electors at the general election in November |
24 | 2012. |
25 | (2) The proposal receiving at least 50% of the total |
26 | votes cast shall be adopted. If no proposal receives at least |
27 | 50% of the total votes cast, the Constitution of Pennsylvania |
28 | shall not be amended. |
29 | (d) Certification.--The secretary shall certify the results |
30 | of the election within three weeks of the general election in |
|
1 | November 2012. |
2 | Section 12. Lobbying. |
3 | (a) Delegates.--The following shall apply: |
4 | (1) Direct lobbying of individual delegates by |
5 | organizations or individuals registered as lobbyists within |
6 | this Commonwealth on the effective date of this section and |
7 | for the duration of the convention, other than meetings |
8 | between individual electors of a senatorial district and the |
9 | delegate or delegates representing the same district, shall |
10 | be prohibited. |
11 | (2) No delegate shall accept any gift, meal, service or |
12 | other benefit, or any promise of such in the future, offered |
13 | by any party in an effort to influence the outcome of the |
14 | convention. |
15 | (b) Convention.--The following shall apply: |
16 | (1) Lobbyists prohibited from lobbying delegates in |
17 | subsection (a)(1) shall be permitted to lobby the convention |
18 | as a whole by the following methods: |
19 | (i) Providing printed reference materials in |
20 | quantities sufficient for distribution to all elected |
21 | delegates, subject to any pertinent policies adopted by |
22 | the convention. |
23 | (ii) Providing printed and oral testimony at a |
24 | hearing before any committee or subcommittee of the |
25 | convention, subject to any pertinent policies adopted by |
26 | the convention. |
27 | (iii) Providing printed reference materials to |
28 | committees or subcommittees of the convention in |
29 | quantities sufficient for distribution to all elected |
30 | delegates, subject to any pertinent policies adopted by |
|
1 | the convention. |
2 | (2) The convention shall not accept, on behalf of its |
3 | delegates, any gift, meal, service or other benefit, or any |
4 | promise of such in the future, offered by any party in an |
5 | effort to influence the outcome of the convention. |
6 | Section 13. Convention open to public. |
7 | Sessions of the convention as a whole and all meetings of its |
8 | committees and subcommittees shall be open to the public. |
9 | Section 14. Judicial immunity. |
10 | Provided no portion of the resultant Constitution of |
11 | Pennsylvania, duly proposed by the convention and adopted by the |
12 | electorate according to the provisions of this act, is found to |
13 | be in violation of the Constitution of the United States, no |
14 | court of this Commonwealth shall have the authority to overturn |
15 | its provisions. |
16 | Section 15. Appropriation. |
17 | If the question in section 3(a) is approved by the |
18 | electorate, the sum of $20,000,000 shall be transferred from the |
19 | nonlapsing leadership accounts of the General Assembly, in four |
20 | equal contributions by the majority and minority caucuses of the |
21 | Senate and the House of Representatives, to carry out the |
22 | provisions of this act. Further sums required by the convention |
23 | to perform its duties, contributed in similar fashion, shall be |
24 | provided upon request by the convention in accordance with |
25 | section 8(c)(2)(vii). |
26 | Section 16. Effective date. |
27 | This act shall take effect as follows: |
28 | (1) Section 15 of this act shall take effect upon |
29 | publication of the notice under section 3(c). |
30 | (2) The remainder of this act shall take effect |

1 | immediately. |
|
