| AN ACT |
| |
1 | Amending the act of June 3, 1937 (P.L.1333, No.320), entitled |
2 | "An act concerning elections, including general, municipal, |
3 | special and primary elections, the nomination of candidates, |
4 | primary and election expenses and election contests; creating |
5 | and defining membership of county boards of elections; |
6 | imposing duties upon the Secretary of the Commonwealth, |
7 | courts, county boards of elections, county commissioners; |
8 | imposing penalties for violation of the act, and codifying, |
9 | revising and consolidating the laws relating thereto; and |
10 | repealing certain acts and parts of acts relating to |
11 | elections," providing for advance voting and for advisory |
12 | committee. |
13 | The General Assembly of the Commonwealth of Pennsylvania |
14 | hereby enacts as follows: |
15 | Section 1. The act of June 3, 1937 (P.L.1333, No.320), known |
16 | as the Pennsylvania Election Code, is amended by adding an |
17 | article to read: |
18 | ARTICLE XIII-D |
19 | ADVANCE VOTING |
20 | Section 1301-D. Advance voting. |
21 | (a) Establishment.--The county board of each county shall |
22 | provide for advance voting to begin no earlier than ten business |
|
1 | days prior to the dates of elections and primaries established |
2 | in accordance with Article VI and to end no later than 8 p.m. |
3 | Eastern Standard Time on the day immediately before the election |
4 | or primary. |
5 | (b) Conduct.--Each county board shall allow individuals to |
6 | vote in the election in the same manner as voting is allowed on |
7 | the date of the election or primary. |
8 | (c) Days and hours.-- |
9 | (1) The county board of each county shall designate the |
10 | days and hours that advance voting sites shall be open, |
11 | provided that all sites throughout the county shall have |
12 | uniform days and hours, shall be open no fewer than eight |
13 | hours each weekday, shall be open a minimum of an aggregate |
14 | eight hours each weekend if weekend voting is approved by the |
15 | county board under paragraph (2) and shall not open prior to |
16 | 7 a.m. Eastern Standard Time or close before 7 p.m. Eastern |
17 | Standard Time. A qualified elector in line at the closing of |
18 | an advance voting site shall be permitted to vote. |
19 | (2) A county board may approve conduct of advance voting |
20 | during the period of advance voting provided in subsection |
21 | (a) on Saturdays, Sundays, or both. The weekend advance |
22 | voting shall be conducted during the hours as provided in |
23 | this subsection. |
24 | (d) Places.--Advance voting shall occur at the main office |
25 | of the county board and in locations as may be designated by the |
26 | county board. The designations shall occur at a public meeting |
27 | of the county board. |
28 | Section 1302-D. Voting checklists and records. |
29 | (a) Compilation.--Voting checklists shall be compiled in |
30 | accordance with section 1212. |

1 | (b) Division.--The voting checklists shall be divided by |
2 | date. |
3 | (c) Records.--Separate records shall be maintained for each |
4 | day of advance voting. |
5 | Section 1303-D. Staffing of polling places. |
6 | (a) Duty of county board.--Each county board shall designate |
7 | sufficient individuals to staff advance voting sites. |
8 | (b) Staff duties.--The individuals staffing advance voting |
9 | sites shall execute the responsibilities of: |
10 | (1) Judges of elections. |
11 | (2) Inspectors of elections. |
12 | (3) Clerks. |
13 | (4) Machine operators. |
14 | (c) Requirement.--Every individual staffing any advance |
15 | voting site shall be a member or full-time employee of the |
16 | county board or an employee of the county to whom the county |
17 | board has provided training equivalent to that given a full-time |
18 | employee of the county board and has demonstrated to the |
19 | satisfaction of the county board an understanding of and ability |
20 | to execute the responsibilities. |
21 | (d) Alternate advance voting site staffers.--A county board |
22 | may designate alternate advance voting site staffers provided |
23 | that all alternate advance voting site staffers meet all |
24 | requirements provided by this subsection. |
25 | Section 1304-D. Advance voting plan. |
26 | (a) Duty of county board.--Each county board shall prepare |
27 | and unanimously approve an advance voting plan no later than 30 |
28 | days prior to an election. |
29 | (b) Contents.--The advance voting plan shall include, but is |
30 | not limited to: |

1 | (1) The names, hours and locations of advance voting |
2 | sites. |
3 | (2) The names of individuals who shall staff the |
4 | respective advance voting sites, including alternative |
5 | advance voting site staff. |
6 | (3) The protocol to preserve the security and integrity |
7 | of voting machines, provisional ballots, voting checklists |
8 | and all other equipment, records and supplies necessary for |
9 | the conduct and successful completion of advance voting. |
10 | (c) Petition.--If a county board of elections has considered |
11 | one or more proposed advance voting plans and has been unable to |
12 | reach unanimity in favor of an advance voting plan, a member of |
13 | that county board may petition the Commonwealth Court to adopt a |
14 | plan for it. If petitioned, the Commonwealth Court may also |
15 | receive and consider alternative petitions from another member |
16 | or members of that county board. The Commonwealth Court may |
17 | adopt an advance voting plan for that county. |
18 | (d) Returns.--The canvass of returns for ballots cast under |
19 | this article shall be substantially the same as votes cast by |
20 | qualified electors in election districts. |
21 | (e) Results.--The results or tabulation of votes cast during |
22 | the period of advance voting shall not be made before the close |
23 | of the polls on election day. |
24 | (f) Reporting.--Advance voting results shall be reported in |
25 | the same manner as votes cast on election day. |
26 | Section 1305-D. Advance voting implementation advisory |
27 | committee. |
28 | (a) Establishment.--There is established an advisory |
29 | committee to be known as the Advance Voting Implementation |
30 | Advisory Committee. |

1 | (b) Members.--The advisory committee shall be comprised of |
2 | the following persons: |
3 | (1) The Secretary of the Commonwealth or his designee |
4 | who shall act as chairperson. |
5 | (2) One county commissioner, as appointed by the |
6 | Chairman of the County Commissioners Association of |
7 | Pennsylvania, from each of the following: |
8 | (i) A county of the first class. |
9 | (ii) A county of the second class. |
10 | (iii) A county of the second class A. |
11 | (iv) A county of the third class. |
12 | (v) A county of the fourth class. |
13 | (vi) A county of the fifth class. |
14 | (vii) A county of the sixth class. |
15 | (viii) A county of the seventh class. |
16 | (ix) A county of the eighth class. |
17 | (3) Four county elections directors as appointed by the |
18 | Commissioner of the Bureau of Commissions, Elections and |
19 | Legislation. |
20 | (4) Two members from the Senate, one appointed by the |
21 | Majority Leader of the Senate and one appointed by the |
22 | Minority Leader of the Senate. |
23 | (5) Two members from the House of Representatives, one |
24 | appointed by the Majority Leader of the House of |
25 | Representatives and one appointed by the Minority Leader of |
26 | the House of Representatives. |
27 | (6) Two county sheriffs, one appointed by the President |
28 | Pro Tempore of the Senate and one appointed by the Speaker of |
29 | the House of Representatives. |
30 | (7) The President of the League of Women Voters of |

1 | Pennsylvania or his designee. |
2 | (c) Roles and responsibilities.--The advisory committee |
3 | shall recommend to the Department of State regarding the |
4 | formulation of technical, administrative and operational |
5 | standards for use in implementing, executing and overseeing |
6 | advance voting. |
7 | (d) Reimbursement.--The advisory committee members shall |
8 | serve without compensation, but shall be reimbursed for their |
9 | necessary travel and other reasonable expenses in connection |
10 | with attendance at meetings called by the chairperson. |
11 | (e) Advisory committee subcommittees.--The chairperson may |
12 | create, within the committee membership, subcommittees to study |
13 | and address specific technical and program areas. |
14 | (f) Advisory committee report of recommendations.--No later |
15 | than 90 days after this section becomes effective, the advisory |
16 | committee shall submit a report of its recommendations to: |
17 | (1) The Secretary of the Commonwealth. |
18 | (2) The General Assembly. |
19 | (3) The Governor. |
20 | (g) Publication.--The Secretary of the Commonwealth shall |
21 | make available for inspection the report of recommendations on |
22 | its public Internet website upon receiving the report. |
23 | Section 2. This act shall take effect as follows: |
24 | (1) The addition of section 1305-D and this section |
25 | shall take effect immediately. |
26 | (2) The remainder of this act shall take effect in 180 |
27 | days. |
